In Chicago, just like all of Illinois, cyclists are subject to many of the same laws as any other motor vehicle. However, there are specific laws that pertain to bicycles that both cyclists and other drivers must follow to keep everyone safe on the roadways. When motorists or cyclists ignore these important rules, serious accidents can occur.

Chicago Municipal Code 9-52-010

Chicago Municipal Code 9-52-010 pertains to all the laws regarding bicycles, which include granting a bicycle the same rights and duties as a motor vehicle and requiring cyclists to follow these rules or they could be subject to fines up to $250.

Other Chicago cycling laws that cyclists must follow to stay safe include:

  • 9-52-020 (d): When a usable bike lane has been provided adjacent to a roadway, cyclists are required to use this lane and not the roadway or sidewalk.

  • 9-52-050: Cyclists riding on the roadway are required to ride single file.

  • 9-52-060: Cyclists are not permitted to carry any packages, bundles, or articles that impede their ability to keep at least one hand on the handlebars.

  • 9-52-080 (a): Bicycles used at night are required to have a headlamp that emits a white light at least 500 feet to the front and a rear red reflector or rear red lamp.

  • 9-52-080 (b): Every bicycle is required to be equipped with a brake.

  • 9-52-110: Cyclists are not permitted to talk or text on a cellphone while riding.

Municipal Code for Motorists Regarding Bicycles

Most of the Chicago Municipal Code regarding bicycles is aimed towards motorists. Because cyclists are at a distinct disadvantage when they share the roadway with motorists, Chicago aims to keep these cyclists safe and protected. Some of Chicago’s Municipal Codes for motorists regarding bicycles include:

  • 9-16-020 (e): When making a left-hand turn, motorists must yield the right-of-way to cyclists traveling the opposite direction, including when the cyclist is in or approaching the intersection.

  • 9-36-010 (c): Motorists are required to provide at least a three-foot buffer zone between their vehicle and the bicycle when passing the bicycle.

  • 9-36-020 (f): Motorists are prohibited from turning in front of a bicycle when both are traveling in the same direction.

  • 9-40-060: Motorists are prohibited from driving, parking, or standing in a designated bike lane.

  • 9-40-160: Motorists must exercise due care to avoid crashing into a cyclist.

  • 9-80-035: Motorists are prohibited from opening their door into traffic until it is safe to do so and only when loading or unloading passengers.

Fines for violating any of the Chicago Municipal Codes can range up to $1000 for the most severe violations. While this may seem steep, remember that these laws are in place to keep everyone safe and to prevent the devastating injuries that cyclists often suffer because of their lack of protection as compared to motor vehicles.
