Billing Inaccuracies

A recurring issue against Comenity Bank is with their billing problems. Numerous clients reported paying off their accounts in full. Weeks or months later, some clients have received billing statements from Comenity while others, notices from collection agencies about missed payments. Comenity Bank’s flawed system had gravely affected many of its consumers’ credit status, resulting in lower scores and even closed credit accounts.

Excessive Late Charges

Another issue consumers found against Comenity Bank is with their incredulous late charges. Many of said charges, reportedly, were paid off but had grown exponentially. According to complaints, Comenity Bank did not send emails to the consumers despite them asking for paperless notices. Others did not receive anything entirely until the interests piled and the bank had sent warnings.

Premature Credit Reporting

Despite errors on their end, Comenity Bank had routinely reported consumers to credit bureaus prematurely. It’s no surprise that many of the bank’s clients have lamented about their credit scores lowering or credit accounts closing.

Identity Theft

Others’ cautionary tale with Comenity Bank is with non-consumers being falsely charged for debts under their names. According to one account, it’s been years of working with proper authorities including Comenity to prove that identity theft had occurred.

Poor Customer Service

Comenity Bank consistently fails its consumers with its sore billing practices and consequent poor customer relations. Many of its consumers had to go back-and-forth weeks, months, and even years to clear up falsely charged debts, clear paid off credit accounts, and clarify interests. Even with their responses to BBB complaints are generically-tailored messages claiming to respond to the issue within 30 days.

Unfortunately, billing inconsistencies, late charges, premature credit reporting, identity theft, and lousy service complaints are just the beginning for Comenity Bank. The bank’s customers are left wondering what options they have regarding their consumer rights.

We Fix Complaints When Customer Service Won’t

Has Comenity Bank used misleading sales tactics? Have you received poor service? Do you have complaints with billing? Do you want customer service at Comenity Bank to listen?

A lot of Comenity Bank Corporation customers aren’t happy with their service and the Better Business Bureau lists 2,651 customer complaints against the company in the past three years, including complaints for billing and collections practices, problems with a service/product, advertising and sales, among others.

If your complaints haven’t been heard, we can help. At Mike Agruss Law we help customers who have been mistreated by big companies–much like Comenity Bank–and we turn your complaints into resolutions!

We’ll not only file your legal demands with Comenity Bank, we’ll negotiate with the company. If your claim isn’t resolved through these negotiations, we’ll work through the legal process that is outlined in your Comenity Bank contract, which is typically arbitration.

Mike Agruss Law gets results–including zero balances, refunds, and other compensation.

Here’s How to Make Big Companies Listen

It can be frustrating when you rely on a service and don’t get the results you’ve paid for. Big companies make mistakes every day and not only is it their fault, but it can also cost you money, time, and leave you with big headaches.

Have you tried calling Comenity Bank to address an issue, only to be told that the representative has no authority to do so? Or maybe you’ve tried talking to someone higher up in the company, only to be ignored, dismissed, or they take too long, continuing to waste your precious time. Maybe you’ve sent an email to the company which only resulted in a prefabricated response or they never follow through with what they’ve promised.

When you’re limited in your choices for service providers or you’re locked into a contract, what can you do?

Fortunately, you do have options.

Use Arbitration to Settle Your Complaint

Most companies like Comenity Bank have an arbitration clause in their contracts to prevent being taken to court for traditional litigation. This is actually an advantage for the consumer. When you request an arbitration hearing, an independent third party (the arbitrator) with knowledge of the type of situation involved will listen to the facts from both sides and make an impartial, binding decision. Comenity Bank will have to do a lot of work and there is no guarantee that they will have a successful outcome.

Arbitration is Fast, Inexpensive, and Private

Arbitration with Comenity Bank is conducted through the American Arbitration Association (AAA). According to the AAA Consumer Due Process Protocol, arbitration through AAA will comply with their Statement of Principles, which includes:

  • The process is fundamentally fair – All parties are entitled to qualified, competent, impartial arbitrators who will conduct a fair hearing.
  • You get access to all relevant information – This includes reasonable costs, confidentiality, reasonable time limits, and meeting times and/or locations that are agreeable to both parties.
  • Transparency – AAA provides clear arbitration agreements and the ability for each side to hire their own representation.
  • Just process – Arbitration allows the arbitrator to award the same relief as traditional litigation in a binding decision.
  • Alternative to arbitration – Mediation and the ability to take the case to small claims court should be available in some cases.

Arbitration Gives you Control and Leverage

When Comenity Bank is alerted that you plan to pursue arbitration, they know it will cost them money out of pocket. Not only do they run the risk of losing the case, but they will also pay for their mistake(s) and the arbitration itself. This gives you more leverage with your demands.

If Comenity Bank doesn’t meet those demands and you have a real complaint, Mike Agruss Law can help by representing you in arbitration where you will get a fair, just, and transparent hearing.

Control and Leverage Triggers Faster Settlements

Large companies like Comenity Bank don’t like the uncertainty and loss of control that comes with arbitration. Not only do they lose the advantage in the situation, but you’re also on equal footing with them in the eyes of arbitration.

The first step in taking on Comenity Bank is to formally raise your complaint. The lawyers at Mike Agruss Law can help you to do so. We will send a letter of demands to the corporate offices of Comenity Bank, letting them know that you’re ready to begin arbitration if a satisfactory resolution is not achieved. Typically, this is 30 days, but it will depend on your specific contract with Comenity Bank.

Approximately 50% of cases will settle before proceeding to an arbitration hearing during this time. However, if Comenity Bank doesn’t offer a reasonable settlement within the appropriate time frame, the next step would be filing a case with AAA. Mike Agruss Law will not only put together the necessary paperwork for arbitration, but we will also help you take the next steps in the arbitration process.

UDAAP and Arbitration

UDAAP is an acronym representing laws that prohibit Unfair, Deceptive, or Abusive Acts or Practices in the context of trade or business. This includes misrepresentation, deception, false advertising, or false promises. These laws emerged following the Dodd-Frank Wall Street Reform and Consumer Protection Act that was enacted in response to the 2008 financial crisis. The ultimate goal with these laws is geared towards protecting consumers involved in financial transactions, educating consumers on their rights, and allowing them access to information and resources to best inform their decisions.

UDAAP laws are regulated by two organizations, the Consumer Financial Protection Bureau (CFPB) and the Federal Trade Commission (FTC). The FTC expanded the initial UDAAP laws in 2004 to include unfair and deceptive acts and practices. Some standards for unfairness, in particular, include if it causes or is likely to cause substantial injury to consumers, the injury is not reasonably avoidable by consumers, and the injury is not outweighed by countervailing benefits to consumers or to competition.

Every state has UDAAP laws, which can vary widely. However, the lawyers at Mike Agruss Law understand these laws and can use them to get compensation for deceptive practices, representing consumers throughout the country in cases of arbitration at no cost to them. The company will not only pay the consumer, but they will also pay my fees as well. The consumer will never pay me a cent.

If you’re dealing with an issue with Comenity Bank, you might try filing a complaint with the BBB or the customer service team with Comenity Bank. Unfortunately, these avenues won’t always lead to a successful resolution for you, the customer. Instead, you may want to consider an experienced arbitration lawyer to take on your case.

Arbitration is a very useful tool for resolving disputes, and Mike Agruss Law can help. With our expert guidance, we bring the big companies to the table and provide the support needed to get your bills corrected, credit reports fixed, improper fees refunded, and more. Let us pick up the sword for you; you have nothing to lose.

How Do I File a Complaint Against Comenity Bank?

We will use your state’s UDAAP law to file a complaint in Arbitration on your behalf at no cost to you. UDAAP laws include misrepresentation, deception, false advertising, or false promises. Under your state’s UDAAP law, you are likely entitled to money damages for your actual damages.  Plus, the other side will pay our fees and costs.  You will not pay us a penny.

Comenity Violated Laws and has been ignoring everyting: Under Indiana Code (IC) 29-3-8-5(b): “Every contract, sale, or conveyance executed by a protected person is VOID….” Therefore, all transactions, even if claimed to be made by Ollie GHOSH, are VOID. Thus, all conveyance and transactions must be retracted, redacted and sealed. Ollie Ghosh is a protected person under IC 29-3-1-13. Any and all information about this “Protected Person” is also protected. In addition to violation of Indiana Guardianship Act-IC Title 29- Probate § 29-3-5-1, you have no property rights to the claim as you have sold the debt to another unlisted party. You also violated §806, §807, and §808 of Public Law 111-203, title X, 124 Stat. 2092 (2010)/Federal ‘Fair Debt Collection Practice Act by making continuing unauthorized and unpermitted claims of a property which you do not own any more. I am the victim of identity theft and I filed a dispute regarding the fraudulent accounts. I had one legitimate card that was not compromised and because if the identity theft and the debt collectors calling me I placed a cease and desist on the fraudulent accounts they were trying to collect on. They then suspended my one account which was an Ulta credit card which I have missed not one payment and I even asked for a new card at the time just in case and they refused and said it wasn’t necessary since there were no unauthorized charges. I recently filed a complaint about them suspending my account for me filing the complaints and demanding they take the accounts off my credit report since they were paid or closed as I had a protection plan on the ones compromised. So today a man shows up to my door which was recorded also stating he was from my mortgage company and verifying my residence? He was from their investigation unit taking pictures of my home and back yard and also I received a letter about the most recently disputed account that was the reason they put the suspension on my account for that I had the cease and desist order on and it they verified it was fraudulent and it’s removed now which the letter just came yesterday and the fraud was reported back in April. I also contacted the CFPB about my report I made as I informed them that they sent someone to my home today to verify my address and using scare tactics on me when I am a victim here and the reason they even came was someone accidentally put my valid account under the fraudulent accounts and now I’m being accused and investigated by them when I am not at fault and they are being deceptive and lying to me. I wanted to keep my account since it wasn’t compromised, but now I just want to close it and not have anything to do with them as they are trying to blame me ,the victim when I have cooperated and done everything I can to try to take care of the identy theft and I’m left now being scared and victimized as they are trying to accuse me of something.

Comenity Bank charged me more interest than what my balance was because a promotional period expired by 16 days. When I realized, I called them and they said it doesn\'t matter because it was on my statement. I received ZERO other mail, email, etc. regarding this. All I want is to pay the balance in full and have the interest charges wiped off.

Hi: I would like to do a consultation with you about a situation I am having with Comenity Bank. I fell behind on payments of a credit card due to an involuntarily reduction in my work week, meaning less income. They started calling me non stop for a month. Sometimes even more than 7 times a day. Some other times over 20 times a day. I even got a call from this lady from customer service and we tried to work things out without luck. They claimed I breached the contract. How? They never explained me. And get this: every time I tried to make a payment they demanded the past due amount and not any given amount. Do you think they breached the law by calling me non stop (and I counted over 200 calls in almost one month)? Is there a way they can be taken to arbitration? Am I entitled to money damages, debt relief and cleaned-up credit reports? And believe me, all this situation has taken a toll on my health, I can tell you I am suffering from high blood pressure and anxiety and even my relationships with family are being affected due to all of this problem. Please please please, help me! Thank you in advance!

I have signed up for automatic payments yet they don\'t charge me. I have emails which state that I have successfully signed up, but they say that it wasn\'t. Then they tried to claim that the charge was declined from the bank and the bank has no charges that came through. They continue to charge me and to give me fines and even effected my credit. they have harassing me with as much as 97 calls.
