According to the Federal Motor Carrier Safety Administration, 107 garbage truck-related fatalities and over 1400 injuries occurred in 2017. We may not see garbage trucks as a threat, however, they clearly pose a notable risk to others. If you or a loved one has been in a garbage truck accident, contact us for a free consultation to see if you may be entitled to compensation.

What kinds of accidents and injuries can occur?

In a garbage truck accident, many occur due to the dark since garbage trucks often do their rounds of the neighborhood in the early morning hours. The most common type is a collision between the truck and another motorist or pedestrian. This would likely cause more damage to the other party since the truck is so much heavier than the average vehicle, weighing up to 80,000 pounds. The other party would likely take the majority of the blow’s impact. The garbage truck driver may be inexperienced, poorly trained, or simply reckless when driving the truck, and thus gets into an accident with another person or object.

Who is liable?

Negligence is the basis of these types of accident lawsuits. Negligence occurs when one party breaches the duty of care that they owe to others on the road and injuries directly resulting from the accident. If the accident occurs because of a collision with another party, it would be best to contact an experienced attorney so that they can investigate the accident and use its resources to determine who was negligent by showing they did not follow the law or rules of the road. If the accident is due to driver inexperience, poor training, or recklessness, then the driver and/or the garbage truck company can be found liable. Here, the driver is negligent since he did not exercise proper care when doing his job. The company is negligent for negligent hiring and allowing them to work when they are unfit for the job and a danger to others.
