Go-karts are a great recreational activity for racing your friends through a fun course. These vehicles can go around 30 miles per hour – fairly fast considering how small and unprotected the go-kart is and the enclosed space that it is used in. Unfortunately, these can end in some harsh accidents. If you or a loved one has been in a go-kart accident, contact us for a free consultation to see if you may be entitled to compensation.

What kinds of accidents and injuries can occur?

In a go-kart race, sometimes an accident can occur from a collision with another go-kart driver. The go-kart could even flip and roll over if the impact is hard enough. The go-kart can also flip over due to defects in the design or maintenance of the go-kart itself. The go-kart could also collide with a wall or another object. These accidents can cause bruising, whiplash, neck and back injuries, concussions, broken bones, and more. A good way to prevent or protect yourself from a serious injury is to wear safety equipment, such as helmets and seat belts. In some cases, fires have been reported to appear out of the go-kart, causing severe burns.

Who is liable?

Negligence is the basis of these types of accident lawsuits. Negligence occurs when one party breaches the duty of care that they owe to others on the road and injuries directly resulting from the accident. Although almost all go-kart facilities make participants sign a liability waiver beforehand so that they can avoid any blame if something goes wrong, you still may be able to bring a case against the facility. In an accident between two go-kart drivers, it would be best to speak with an attorney who can help you to determine who was acting negligently at the time. If the accident occurs due to spontaneous fires or inherent defects in the go-kart, the liability likely will fall on the go-kart manufacturer for not releasing a flawed product to the public. If the accident is due to poor maintenance of the go-kart, the go-kart facility can be held liable. It is the facility’s duty to ensure their vehicles are safe for use.
