The Fair Debt Collection Practices Act (“FDCPA”) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA. The FDCPA is a laundry list of what can and cannot do while collecting a debt, as well as things debt collectors must do while collecting a debt. If is harassing you over a debt, you have rights under the Fair Debt Collection Practices Act.

The Telephone Consumer Protection Act (“TCPA”) protects you from robocalls. Robocalls are those annoying, automated, recorded calls that a computer makes to you all day long. You can tell it’s a robocall because either no one is on the other end of the line or there’s a delay when you pick up the phone before a live person comes on the line. You can get $500 per call if violates the TCPA. Have you received a message from that sounds pre-recorded? Or, maybe the message you received from is cutoff at the beginning or the end? These are tell-tale signs that the message is pre-recorded. If you have these messages on your cell phone, you may have a TCPA case against Hunter Warfield.

The Electronic Fund Transfer Act (“EFTA”) protects electronic payments that are deducted from bank accounts. If took unauthorized deductions from your bank account, you may have an EFTA claim. , like most collection agencies, wants to set up reoccurring payments from consumers. Imagine how much money gets if hundreds, if not thousands, of consumers electronically pay them $50-$100, or more, per month. If you agreed to this type of reoccurring payment, must follow certain steps to comply with the EFTA. Did continue to take electronic payments after you said stop? Did take more money from your checking account than you agreed to? If so, let’s talk about your rights under the EFTA.

The Fair Credit Reporting Act (“FCRA”) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We handled a lot of cases recently where reported debt on a consumer’s credit report. likely reports on credit reports to obtain greater leverage over the consumer. If is on your credit report, they may tell you if you pay the debt, they’ll remove it from your credit report. This is commonly known as pay for delete. You pay , and they delete the debt from your credit report. Even if is not on your credit report, maybe the original creditor is. If you pay off the debt to Hunter Warfield, then the original creditor, and Hunter Warfield, should accurately report this on your credit report.

Several states also have laws that provide its citizens an additional layer of protection. North Carolina, for example, has one of the most consumer-friendly statutes in the country. Our NC clients have received some great results in debt collection harassment cases. If you live in NC, and is harassing you, you have tons of leverage to get a great settlement.

For example, if you owe Fingerhut, and is collecting on it, both Fingerhut and may have separate entries on your credit report. Complaints against Hunter Warfield

If you’re on this page, chances are you are just like the hundreds of consumers out there being harassed by Hunter Warfield. Below are some complaints from the Better Business Bureau (“BBB”) and various consumer websites. is not accredited by the BBB. However, the BBB gives a “B” rating. Despite its “B” rating, there are over 490 complaints on the BBB.Here are some of the many BBB reviews and complaints regarding :

  1. “I understand that this company is a debt collector and they want to collect money for the clients that they represent, however the way they treat the people they are collecting from is unacceptable. I have had to cancel two payments in a row because of my inability to pay. The representative that I had spoken to treated me with absolute cruelty. I had explained to him that I was unable to pay this month because I do not make enough money to pay this debt. He then asked why I started a payment plan if I was just going to cancel the payment each month. Obviously I want to pay this debt, but the fact that I have his account in collections is because I could no longer afford to live where I was living. By the end of the call I basically had to tell him that I was poor and was unable to pay this month and then told me if I refuse to pay this month then his client will be forced to proceed in which he never told me what that meant. After telling him I have to refuse to pay this month he told me that his client will proceed, still having no idea what that means, and then ended the call by telling me good luck and hung up without giving me a chance to speak.”
  2. “Horrific customer service! Never in my life have I been talked down to so aggressively and demeaned by a team of predominately large ego, middle-aged men. I have only spoken with one individual who treated me like a human being, yet every time I am contacted and request to speak to an individual who isnt verbally attacking me I am spoken down to even further….. If you’re a heartless, greedy company with a shady lease that preys upon the marginalized disabled and senior populations then this company would be perfect for you in recovering debts!”
  3. “I am currently dealing with this organization. They have called me several times. My wife’s name was used as a co-signer for a condominium lease, and the rental company has sent it to collections. I have opened a fraud case with the San Diego City police, and provided them with the case number but they repeatedly call back. The people are not unpleasant to deal with, but I should not have to provide them the fraud case data more than once.”

Out of 253 reviews on Google, Hunter Warfield only received a 1.5 star rating. Here is a snippet of the reviews on Google:

“These are the rudest people i have ever dealt with. I am trying to take care of a debt from 2013 and had the displeasure of speaking with Eduardo. He basically was not able to work with me at all while asking for private information that was not needed to get this resolved. After he basically yelled at me I asked to speak with a supervisor which then resulted in him hanging up on me. I was pretty sure the whole reason for debt collection companies is to come to an agreement and get the debt paid. Not treat you like a piece of garbage and hang up. RIDICULOUS!”

“This company needs to be put out of business they are by far the rudest people I have ever spoken to. Every review on here is true and they need to be exposed.”

“Horrible horrible customer service! We paid the FULL amount & have proof & they keep harassing me & my family. Calling our business & sending letters. We have proof that we paid. Disgusting repulsive company!!!!! I’m going to file a complaint with the BBB. Michael extension 208 is “handling” our case.”

Can Hunter Warfield Sue You?

Although anyone can sue anyone for any reason, we have never seen sue consumers. It’s likely does not sue because they do not always own the debtthey are collecting on. Also, would have to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s likely collects debts through the entire country. Therefore, it would be very difficult to have lawyers, or a law firm, licensed in every state. There are collection agencies that do sue consumers. For example, Midland Credit Management is one of the largest junk-debt buyers. Midland Credit Management collects on debt and also sues on debt. The opposite is true with . Therefore, it would be very unusual if sued you. The original creditor, on the other hand, may hire a collection firm, or lawyer, to sue you. If has threatened to sue you, call us. We can help.

Can Hunter Warfield Garnish Your Wages?

No, not unless they have a judgment. If has not sued you, then cannot get a judgment. Minus limited situations (usually dealing with debts owed to the government for student loans, taxes, etc.), in order to garnish someone’s wages, you need a judgment first. In short, we have not seen file a lawsuit against a consumer. So, cannot garnish your wages, minus the exceptions listed above. If has threatened to garnish your wages, contact our office right away.

I was contacted (inappropriately) via email regarding an alleged debt owed to an apartment community in which I was wrongly evicted. According to the initial notice, purportedly Hunter Warfield contends that they have permission to contact me via email. I totally disagree as I am unfamiliar with this entity nor did they provide verification that I consented to receiving communication via email. Notwithstanding, despite adamantly refuting the alleged debt owed and providing substantial proof to the contrary, they are in direct violation of the FAIR DEBT COLLECTION PRACTICES ACT and provided no valid proof to substantiate an alleged debt owed. Twice I provided adequate documentation to refute the allegations for which it was totally ignored. I learned that the debt had been placed in Collections on my Credit files via my Credit Monitoring Service. I had a rather not so pleasant conversation via telephone with the company to no avail. Presently, I am homeless and unemployed. I also retain a Government Security Clearance that is now in jeopardy due to the negative reporting of this Collection account further impeding my efforts to regain employment.
