Yes. Even if you were partially at-fault in an accident as a pedestrian, you may still pursue a personal injury claim for the injuries and/or damages you sustained.
Although pedestrians are at great risk of personal injury in traffic accidents while vehicle-drivers typically are not, fault in these accidents does not always clearly and fully belong to the driver. The traditional theory of “pure contributory negligence,” under which plaintiffs couldn’t be compensated if they were at-fault to any extent, was abolished by the Illinois Supreme Court in Alvis v. Ribar 85 Ill. 2d 1 (Ill. 1981).
