Motorcycle Accident Claims


Even minor motorcycle accidents can have devastating consequences. Although helmets have reduced the risks of traumatic brain injuries (TBIs) among motorcyclists by about 70% and are now required in twenty U.S. states, there are inevitable and unavoidable risks of injury when riders are thrown from their bikes in a collision. The National Highway Traffic Safety Administration (NHTSA) reports that “more than 80% of all reported motorcycle crashes result in injury or death to the motorcyclist.”

The NHTSA has uncovered other alarming facts, as well: about 43% of all fatal motorcycle accidents involve alcohol, and “an estimated one-third of motorcycle operators killed in crashes are not licensed or are improperly licensed to operate a motorcycle.” Common injuries in these accidents include TBIs, broken or severed limbs, and spinal injuries, some of which may eventually lead to paralysis.

Although we always encourage the utmost safety and caution when operating or riding motorcycles, Illinois has no fines or law statutes regarding helmets, and the only relevant standards are those imposed by distributors and manufacturers of helmets, according to Federal Motor Vehicle Safety Standard 218.
