A recent case of occupational injury has been settled out of court. 28 year old Ryan Vrabel was working as an oiler on a construction project when his left hand was yanked into the unguarded belt drive of the crane he was powering up. The injuries were to Vrabel’s nondominant hand, which suffered near amputation of his thumb, and other injuries to his pinky and ring fingers. His thumb was surgically reattached.

Vrabel filed suit against the developer of the project and the general contractor, arguing the crane was in an unsafe condition and was in the defendants’ possession, custody, and control. Unspecified past and future medical expenses (but not lost earnings) were claimed. Vrabel’s workers’ compensation carrier asserted a lien of about $60,000; all parties settled on $1.5 million.
