Personal Injury Claims – Six Misconceptions

1) I don’t need an attorney because I have insurance.
Insurance companies are for-profit businesses which employ highly-trained attorneys, investigators, and claim adjusters; the initial offer to settle your personal injury claim is almost always less than your coverage’s full amount and insufficient to cover expenses such as medical bills. It is not only ill-advised to negotiate with an insurance company by yourself, but anything you say to them may be used against you in the future. Hiring an experienced attorney is essential for these reasons.

2) I can just hire an attorney later if I need one.
Waiting to hire an attorney can ruin your chances of success, as valuable evidence to support your claim may be lost over time. It’s also important to remember that accepting insurance money [or any other offer] from the insurance company for a particular incident means that you forfeit the right to file a lawsuit for that incident.

3) It’s too expensive to hire an attorney.
If you have been seriously injured in an accident, you can’t afford not to hire an attorney! The likelihood of earning your just compensation without an experienced attorney is significantly lower, and those who are not well-aware of their coverage are simply at the mercy of their insurance company. 5) Resolving my case will take far too long.

6) My personal injury case can be handled by my estate/divorce/family lawyer.
Lawyers, like doctors, often specialize in particular areas of their field. You would not trust a general physician to perform heart surgery or a divorce lawyer to handle your estate; as such, you should trust only the most experienced personal injury attorneys to handle your claim.
