If you are struggling financially due to medical debt, mortgage debt, credit card debt, or other reasons and considering filing for bankruptcy, Chapter 7 may be the best option to implement an automatic stay, stop the harassment, and regain control of your finances. In Illinois, one mandatory step for those who file for bankruptcy is “pre-bankruptcy counseling.” As part of your bankruptcy application, you’ll need to provide a certificate of completion for credit counseling from a counselor approved by the U.S. Trustee Program from the Department of Justice. Only approved counselors are able to provide certificates of completion, as they are created by a centralized and automated system and numbered individually. These counseling sessions typically last 60 to 90 minutes and include a financial assessment and discussion of budgeting and possible bankruptcy alternatives. While these meetings are traditionally conducted in-person, they may also occur online or over the phone. The session usually costs about $50, but you may apply for a fee waiver or pay the fee in installments if you cannot pay upfront. It’s highly recommended to do your research before choosing a credit counselor, as their strategies can vary and some may provide more information and better service than others. Make sure you check the counselor’s credentials, as well as all fees and available services. To learn more about the benefits of filing for Chapter 7 bankruptcy, contact an experienced bankruptcy attorney today for a free consultation.
