Do you have problems with over a debt?  You are protected under various state and federal laws.  For example, you have rights under the Telephone Consumer Protection Act (TCPA), the Electronic Fund Transfer Act (EFTA), and the Fair Credit Reporting Act (FCRA).

  • The TCPA has been around since 1991 and protects people from unwanted solicitation calls, robocalls, faxes, and text messages.  Under the TCPA, you may receive between $500 and $1,500 for each illegal robocall, text, and fax.
  • The EFTA was established in 1978 and works to protect consumers who use electronic methods of managing finances.  Under the EFTA, written permission must be given in order for a company to take an electronic payment from your bank account.
  • The FCRA was established in 1970 and protects the information in your credit report, among other things.  If your credit report contains inaccurate information, the FCRA gives you leverage and rights to dispute the inaccurate information in your credit report.

Seterus is a "pretend servicer" that nasty old racketeering Bank of America uses on many of their loans. I think this is because they wish to take some of the heat off of them since they have paid out over $200 BILLION DOLLARS in fines. penalties, and court case settlements like the "Morrow Case" in Montana (see what Supreme Court Justice Laurie McKinnon had to say about B of A's left hand not knowing what the right is doing). I have been fighting these dirty bums for nearly 6 years now and the Colorado Courts mostly hide behind unfair (some say unconstitutional) Rule 120 which I found out the hard way on one wrongful foreclosure and now another one they are trying through the very crooked and fined by the state of Colorado AG back in late 2014 Janeway Law. I had all the evidence and most recent court rulings that prove borrowers have standing (look at the top of the deeds of trust on most loans that proves borrowers have standing). Once again the Janseway lawfirm used foreged, fabricated, phony and even robosigned documents (all facial) to the judge and the judge did not even know the difference between a "holder in due course" and a claimed "possessor of a note and trust deed". I rescinded all five of my initial loans that were allegedly with Countrwide Home Loans and the crooked attorneys B of A and Seterus used to try and intimidate me could not provide any real, true, and correct documents to prove who the hell might have the originals. My guess is NONE of them, as MERS was also used and many know all about that scam. It is really sad because our very own government is in on all this with FHFA, GSE. Fannie and Freddie and they are all phonies who have nothing but what has been produced in all the document paper mills like in Ventura County CA and Broomfield, CO. What a total joke and the CFPB is really a joke. Semper Fi, we are gaining slow but sure!!!
