CBV Collections Lawsuits

If you want to know just how unhappy consumers are with CBV Collections, take a look at the number of lawsuits filed against CBV Collections on the Public Access to Court Electronic Records (“PACER”). PACER is the federal docket throughout the country that lists federal complaints filed against CBV Collections. When you do a search for CBV Collections, Inc. there are 6 lawsuits filed against CBV Collections. Most of these lawsuits involve consumer rights’ violations.

CBV Collections Complaints

The Fair Debt Collection Practices Act (“FDCPA”) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA. The FDCPA is a laundry list of what CBV Collections can and cannot do while collecting a debt, as well as things debt collectors must do while collecting a debt. If CBV Collections is harassing you over a debt, you have rights under the Fair Debt Collection Practices Act.The Telephone Consumer Protection Act (“TCPA”) protects you from robocalls. Robocalls are those annoying, automated, recorded calls that a computer makes to you all day long. You can tell it’s a robocall because either no one is on the other end of the line or there’s a delay when you pick up the phone before a live person comes on the line. You can get $500 per call if CBV Collections violates the TCPA. Have you received a message from CBV Collections that sounds pre-recorded? Or, maybe the message you received from CBV Collections is cutoff at the beginning or the end? These are tell-tale signs that the message is pre-recorded. If you have these messages on your cell phone, you may have a TCPA case against CBV Collections. The Electronic Fund Transfer Act (“EFTA”) protects electronic payments that are deducted from bank accounts. If CBV Collections took unauthorized deductions from your bank account, you may have an EFTA claim. CBV Collections, like most collection agencies, wants to set up reoccurring payments from consumers. Imagine how much money CBV Collections gets if hundreds, if not thousands, of consumers electronically pay them $50-$100, or more, per month. If you agreed to this type of reoccurring payment, CBV Collections must follow certain steps to comply with the EFTA. Did CBV Collections continue to take electronic payments after you said stop? Did CBV Collections take more money from your checking account than you agreed to? If so, let’s talk about your rights under the EFTA.The Fair Credit Reporting Act (“FCRA”) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We handled a lot of cases recently where CBV Collections reported debt on a consumer’s credit report. CBV Collections likely reports on credit reports to obtain greater leverage over the consumer. If CBV Collections is on your credit report, they may tell you if you pay the debt, they’ll remove it from your credit report. This is commonly known as pay fordelete. You pay CBV Collections, and they delete the debt from your credit report. Even if CBV Collections is not on your credit report, maybe the original creditor is. If you pay off the debt to CBV Collections, then the original creditor, and CBV Collections, should accurately report this on your credit report.Several states also have laws that provide its citizens an additional layer of protection. For example, if you live in California, Texas, Florida, North Carolina, Wisconsin, Michigan, Montana, or Pennsylvania you may be able to tack on a state-law claim with your federal law claim above. North Carolina, for example, has one of the most consumer-friendly statutes in the country. If you live in NC, and you’re harassed over a debt, you may get $500.00 - $4,000.00 in damages per violation. We work with a local counsel in NC. Our NC clients have received some great results in debt collection harassment cases. If you live in NC, and CBV Collections is harassing you, you have tons of leverage to get a great settlement.

HOW CAN WE USE THE LAW TO HELP YOU?

We will use state and federal laws to immediately stop CBV Collections debt collection. We will send a cease and desist letter to get the harassment to stop the same day. If CBV Collections violates the FDCPA, EFTA, FCRA, or any state laws, you may be entitled to money damages. For example, under the FDCPA, you can get up $1,000.00 in damages plus actual damages. The FDCPA has a fee-shift provision. This means, CBV Collections pays our attorney’s fees and costs. If you have a TCPA case against CBV Collections, we will handle it based on a contingency fee.THAT’S NOT ALL…We have helped hundreds of consumers stop phone calls from CBV Collections. We know how to stop the harassment and get you money damages. ONCE AGAIN, you will not pay us a penny for our time. We will help you based on a fee-shift provision and/or based on a contingency fee. That means, CBV Collections pays our attorney’s fees and costs.

What If CBV Collections Is On My Credit Report?

Based on our experience, CBV Collections may credit report. That means, CBV Collections may mark your credit report with the debt they are trying to collect on. In addition to CBV Collections, the original creditor may be on your credit report. For example, if you owe a hospital debt, and CBV Collections is collecting on it, both the hospital and CBV Collections may have separate entries on your credit report. This is important because you will want both parties to update your credit report if you pay off the debt.THE GOOD NEWS IS…If CBV Collections is on your credit report, we can help you dispute it. Mistakes on your credit report can be very costly. Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft. If you have a mistake on your credit report, there is a process to dispute them. My office will help you pull your credit report and dispute any inaccurate information.REMEMBER…If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (“FCRA”), you may be entitled to statutory damages up to $1,000.00, plus the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision. This means, the credit reporting agency pays your attorney’s fees and costs. Therefore, you will not pay me a penny for my time. We have helped dozens of consumers fix inaccurate information on their credit reports.

Complaints against CBV Collections

If you’re on this page, chances are you are just like the hundreds of consumers out there being harassed by CBV Collections. Below are some complaints from the Better Business Bureau (“BBB”) and various consumer websites. CBV Collections is not accredited by the BBB, however the BBB gives CBV Collections a “C” rating. Here is part of a BBB complaint against CBV Collections:
  1. “The FCRA says that information is inaccurate incomplete of false it should be removed from a consumers credit profile. Being that CBV is being dishonest, misleading, and misrepresenting themselves they should remove the information. My attorney will attempt to contact them again within the next 15... days. They have violated several statues of the FCRA and GABPA laws.”
Here are some of the things that consumers have to say about CBV Collections on other consumer sites:
  1. “I have been receiving phone calls beginning at 7am every morning from them and they continue all day whether I speak with them or not. They have now begun to call my home phone and then immediately my cell phone. …They call me right up until 9:30 at night, and wake my kids up. I have spoken with them and told them that they need to stop calling so often, but they said until I send them the money owed they will have to continue calling. I’m not sure what account they are talking about, and they are beginning to cause a lot of stress.”
  2. “We are getting phone harassing phone calls daily from CBV for a person who has the same last name. They claim it’s a contact number for the person which is impossible as we just got the number about 5 weeks ago. My wife and I have been harassed for the better part of 4 or 5 years. I’ve sent an e-mail to their head office and was assured that the phone calls would stop. We moved and changed the number and the phone calls still continued!”
  3. “I am reading about this cbv collections harassment suit and they call me 12 times a day i have never received mail ever from them and they harass me every day and are rude. I dnt have much service right now so email is all i really have when i am at work!”

Can CBV Collections Sue You?

It is possible that CBV Collections may sue consumers. It seems that CBV Collections only collects debts in the Georgia area, making it easier for them to be familiar with the local court system, and they employ a legal team to handle judgments and garnishments. However, threatening to sue and actually suing a consumer are two different things. If CBV Collections has threatened to sue you, call us. We can help.

Can CBV Collections Garnish Your Wages?

Possibly. Usually a company cannot garnish your wages unless they have a judgment. If CBV has not sued you, then CBV cannot get a judgment. Minus limited situations, dealing with debts owed to the government for student loans, taxes, etc., in order to garnish someone’s wages, you need a judgment first. So, CBV cannot garnish your wages, minus the exceptions listed above, unless they have a judgment. If CBV has threatened to garnish your wages, contact our office right away.

CBV Collections Settlement

If you want to settle a debt with CBV Collections, ask yourself these questions first:
  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will CBV Collections remove it from my credit report?
  5. If I pay this debt, will the original creditor remove it from my credit report?
  6. If I pay this debt, will I get something in writing from CBV Collections confirming the payment and settlement terms?
These are not the only things to consider when dealing with debt collectors. We are here to help you answer the questions above, and much more. Whether it’s harassment, settlement, pay for delete, or any other legal issue with CBV Collections, the folks at Agruss Law Firm are here to help you.

CBV HAS NO WE EMPATHY. THEY WILL NOT TAKE MY PAYMENT. I CANNOT AFFORD THEY'RE MINIMUM PAYMENT

Michael Agruss Headshot

Hi Haley. I'm sorry to hear that CBV is not working with you and is refusing your payments. Do you have a copy of the contract you have with them? You can send it over to my office and I will look it over, then give you a call to discuss your options. My email address is [email protected] Thanks, Mike

I was writing my whole situation and u disconnected me. That's what I was doing but I was disconnected. Guess I was taking to long. Anyway, CBV are harassing my 90 yr old mother who suffers from dementia and has had 2 strokes. It's BC medical who continued to charge me for 10 yrs after leaving the province even though I canceled before leaving. This is causing her a lot of stress. I called them and they said they would stop but I don't believe it. I need to enforce this some how. I just need to stop these calls to her ASAP. It's not good for her health to be stressed out and afraid to answer her phone. I gave you my email. I thought your firm only practiced in the states?!

Michael Agruss Headshot

Hi Lee. Canadian residents have some of the same options as American residents in getting those annoying calls to stop. You have the right to send a cease and desist letter to CBV if they are harassing your mother. I would recommend you send it via postal mail and strongly recommend you send it as a registered letter as to provide a paper trail and proof that it was sent and received. If you need help with that, you can certainly reach out to me and I will contact your via the email provided as well. Thanks, Mike

Do you have any firms in Canada? Can you recommend anyone in Canada? Thank you!

Do not pay to a collections agency. What these people is buy from debts from companies. Let's say you owe $2000 the collection agency will buy it pennies on the dollars. On that of that it will make your credit rating worse. If they harass you you can contact them and threaten legal action. By law they are only allowed to call you on occassion. Also threaten to report them and they will stop. These idiots called me for a year for money I didn't owe and when I threaten them with legal action they stop real quick.

Michael Agruss Headshot

Hi Miketo. Thanks for sharing your story and you are correct in what these types of companies do. If you need any help in dealing with debt collection agencies, feel free to contact my law firm. Thanks, Mike

just received a call from cbv collections 416 area code, looking for someone who has never had this number. i imagine it was them cold-calling thru the phone book. asked for an Emmanuel Jones. listing has been W Jones for ages; no Emmanuel in the family. i bristled, "pardon me? who's calling?" etc. they did immediately i remember say it was so-and-so from CBV Collections but then want to cross-examine me on being evasive or somesuch collision between me wanting unknown caller at my doorstep to be polite and ID themself before asking to summon anyone, and them --disclosing really-- as collection agency wondering whether number is hiding who or whatnot. call wasn't harassing. asking "who's calling?" is my routine. typ. it's a telemarketer; here i suppose my first experience with aggressive misdirected collections. which via google and your site and chat pop-up lands me here, "oh some brand new world and somehow this firm wants to ask me about it", is all. but the whole thing is very minor, and origin and destination both supposedly in canada. small detail, there became some quick back-n-forth on why i wasn't disclosing whether i was Emmanuel etc.; caller wondered outloud why i would like to hide that from a collection agency. i was saying i thought unknown callers to my home ought to ID themselves, simple politeness. *click* on their end!

I was wondering if I could get some information about CBV collections. I have been receiving phone calls beginning at 7am every morning from them and they continue all day whether I speak with them or not. They have now begun to call my home phone and then immediately my cell phone. I am wondering what I can do about this? They call me right up until 9:30 at night, and wake my kids up. I have spoken with them and told them that they need to stop calling so often, but they said until I send them the money owed they will have to continue calling. I'm not sure what account they are talking about, and they are beginning to cause a lot of stress. I have looked at your numbers list and I see the numbers that have been contacting me in there!

Michael Agruss Headshot

Hi Lisa. Have you kept a record of the times they're calling you? If they are calling before 8am and after 9pm, they could be violating your rights and the law. You have the right to submit a cease and desist letter to them to inform them to stop calling you, as well as request a debt validation letter from them. I can help you with both of these issues, feel free to contact me at your earliest convenience. Thanks, Mike

Hi Michael. This is especially frustrating and I can understand that you are tired of getting these types of calls for someone else. I have a debt with TD Canada, and this collection agency calls me at a minimum of 4 times per day. As early as 7 a.m. how do I make it stop? Will changing my number help? I have told them recently that I now will be commencing the paayment of my debt. As I have a job now, yet they continue to call me every day multiple times. And argue with me when I tell them that I am at my place of work. This has been going on since August 2013, so almost an entire year and it's driving me up the walls. I'm sorry for being so reserved but with what has been happening with TD id rather not disclose more information to anyone until I am receiving an email!

Michael Agruss Headshot

Hi. You have some options in getting these calls to stop. Changing your phone number likely won't help, these types of companies can be relentless in finding you no matter where you are or what number you use. I would be happy to talk with you about how to get the calls to stop, please give me a call at 312-224-4695. Thanks, Mike

Hey, Cbv collections Ltd has been harassing me by calling me 5-6 times a day, sometimes back to back. I understand I have debt that must be collected, and I am paying it back slowly. But I just want them to stop calling me every five seconds. I took out a credit card with Bmo Bank. It is a Mastercard. I used it to help my mother out since she is a single mother of three with a relatively low income. At the time I had four credit cards and maxed out all four. Two of the four went to collections. I have paid off 2 completely and I am almost done paying off my third. On the card that is regarding this matter, I owe a little over a grand which I am struggling to pay off since I am a university student with a min wage part time job. Cbv calls me soo much. One day they called me and I picked up and told them I was going to make a payment. They then told me that was too little and I have to pay it off all at once. After telling the agent that wouldn't be possible and ending the call. Three minutes later, another agent called back asking me when I would make a payment!

Michael Agruss Headshot

Hello Falicia. You have the right to have the harassment to stop. I would suggest you send CBV Collections a registered cease and desist letter, which I can help you with. If they continue to call you after they have received the letter, they could be violating your rights. I will give you a call or you can reach me at my office at 312-224-4695. Thanks, Mike

Hi Triston. Give me a call so we can discuss how you can get these calls to stop. My number is 312-224-4695. You can also email me at [email protected] Thanks, Mike

CBV keeps calling claiming I owe CCRA money but I have contacted the Gov of Canada and was told they don't sell accounts to collections

Michael Agruss Headshot

Hi Karen. Let's talk more about this when I give you a call. Thanks, Mike

WELL THEYVE CALLED ME 5 TIMES TODAY ALONE AND THEY JUST GOT MY FILE 4 DAYS AGO. THE BILL IS FROM MSP JUST FROM THIS FISCALYEAR!

Michael Agruss Headshot

Hi Monique. It is amazing how relentless these debt collection companies can be. What times are they calling you? Do you have a record of the calls? If so, send it over to my office at [email protected] I will then be in touch. Thanks, Mike

I was hurt at my job is that the reason ?Little hesitant to give any information I don't know if this is a scam!

Michael Agruss Headshot

Hi Jesse. Do you possibly have medical bills that CBV Collections is attempting to collect on? Do you have other debts that they may be pursuing? You can send a request for a debt validation letter from CBV, which I can help you with. My office number is 312-224-4695, reach out when you have some time to discuss this further. Thanks, Mike

I just read up on your CBV page and I believe that they may have called my godfather asking for a 10000 debt that he does not owe. they called using the number 18883261036 and said he owed money on a debt from the 1990s, they also claimed to be from TD canada bank note they said bank not canada trust. the man said his name was ian but refused to give any more information!

Michael Agruss Headshot

Hi Timothy. Debt collectors can be quite hesitant to give out any information yet they request it from consumers all the time, sometimes bullying them into giving it. You can request that CBV provides a debt validation letter, which is your right under the law. This way the debt can be determined to be legitimate or possibly a scam. Feel free to reach out to me at my office at 312-224-4695. Thanks, Mike

CBV has been calling me multiple times a day every week for years in reference to a debt which is more than 7 years old. The debt does not appear on my credit report but CBC hits my credit report on a daily basis severely negatively affecting my credit score. I have all their numbers blocked on my phone but I have record of their harassment I need them to stop.

Michael Agruss Headshot

Hi Jamie. Debt collectors can continue to call consumers about debts even after the statute of limitations on filing a lawsuit. Debts do not "go away" unless you file for bankruptcy or pay them off. I can understand being frustrated that your credit score is being affected, I can help you with this situation. Give me a call at 312-224-4695. I look forward to speaking with you. Thanks, Mike

Rogers and CBV Collections, has an agreemwnr with each other. rogers pays cbv collection for older accounts, meaning, they are paid by rogers communications to ONLY hasrass people while they cannot collect the debt. what's the purpose of this: rogers is truly an evil company. they pay CBV Collections, Inc. to harass people where rogers or CBV Collections, Inc. can no longer collect that debt. the debt may be legit or not in some cases but they are there to create a night-mare for people. this is evilness at its best by rogers company and CBV Collections, Inc.. they love creating pain and hardship for people who already has or is in pain of finanical and they want to kick these poor people further to the ground to hit them harder and harder each time. there should be a national class action lawsuit against CBV Collections, Inc. and rogers. rogers must learn a lesson to not be evil. rogers has to learn from bell canada, to not go to extreme to harass people. their act is beyond harassment. if rogers communications or CBV Collections, Inc. has power and can get their hands on you to even get rid of f you. they will do it and will not hesitate. rogers communications and media follows an old ritual evil practice they do which is a step lower than sacrificing. they would sacrifce people for even $100. this is hard to belive but they will do it. it's a shame that a company goes this far for money to harass people beyond the means of life or laws. they will face justice soon.

In regards to CBV collections, if they call several times a day, leave recordings as messages that don't make sense, is there a precedent for any successful legal action?

Hi Danielle, I believe 416-482-7690 is a number from CBV Collections. Have you received a letter from CBV Collections? Is this debt on your credit report? I can help you dispute with the original creditor, Homestead, and with CBV Collections. If you do not owe this debt, and you never received a bill, no one should should be harassing you over a debt. I will contact you so we can further discuss this on the phone. Thanks, Mike

I have been turned over to the magistrate court because of CBV. They had an office in cordele ga where I made arrangements with the court to pay monthly payments. This office relocated and did not contact me or leave me any forwarding information. Now they have again turned me over to the magistrate court for this bill and are seeking to garnish my wages. There is still no contact information for this office even on the court papers sent to me. How can I pay them if I do t know where they are?

416-482-7690 keeps calling me, I answered once and they said I owed Homestead ( building I lived in over a year ago) $750 that I was never billed for, they said " for apartment cleaning" after I moved out ... they renoed the apartment right after I left including new floors and everything ( I know, at the time fiance was working on the reno crew. He did multiple other apartments that were in worse condition and did not get charged) I moved out last year in April and i'm just getting informed of this now? how can they put me into collections before I ever received a bill?

Hi Jesse, About 20% of the cases I handle are collection agencies calling my clients on debts they do not owe. Once you tell a collection agency they have the wrong number, they must stop calling. Period. CBV Collections cannot continue to harass you over a debt you do not owe. Under the Fair Debt Collection Practices Act ("FDCPA"), you are entitled to money damages up to $1000. Plus, CBV Collections would have to pay your attorney's fees. I will contact you so we can discuss this further. At the very least, I'll help you stop the calls from CBV Collections. Thanks, Mike.

Hi Ross, Once you tell a collection agency to stop calling, they have to stop calling. You have rights under the Fair Debt Collection Practices Act ("FDCPA"). If you told CBV Collections to stop calling you and they continue to call you, CBV has violated the FDCPA. There's case law that says one call after an oral cease and desist request is evidence of the collection agency's intent to harass the consumer. If CBV Collections violated the FDCPA, you are entitled to money damages to up $1000 and CBV Collections would be reasonable for my attorney's fees. You will not owe me a dime. Also, if CBV Collections is calling your cell phone using an automatic telephone dialing system, and you told them to stop calling, then CBV Collections has also violated the Telephone Consumer Protection Act ("TCPA"). Under the TCPA, you can get $500 in damages per call! I will contact you so we can discuss this further. Thanks, Mike.

CBV calls me on my cell phone repeatedly during business hours, while I am at work. (My cell phone is used for both personal and work purposes). I have previously asked them to stop calling me on that number as it disrupts me at work, but they continue to call multiple times/day.

they are contiunally calling me regading an OWEN nicholson ( my middle name) i am up to date on all bills and have no idea why they think im OWEn nicholson and i have told them im Jesse and they keep calling up to 10x a day. maybe there was some fraud but its not me as i have never put anything under the name of Owen
