According to the National Highway Traffic Safety Administration (NHTSA), 3,166 people died from distracted driving in 2017. They define distracted driving as any activity that diverts your attention from driving, which most notably includes cell phone usage, eating or drinking, and drunk driving; all types of distracted driving have the potential to be deadly. Specifically, the Center for Disease Control cites three types of distraction: visual, manual, and cognitive. Each type is capable of tremendous damage within a few seconds of distraction. Oftentimes, young drivers seem to be involved in these accidents from either drinking one night and thinking that driving is safe, or using their cell phones frequently while driving.

All fifty states have laws prohibiting drunk driving. Most states have laws prohibiting cell phone usage while driving. Most of these laws focus on texting while driving, but generally, hands-free driving laws are also prevalent. There are no laws against eating or drinking while driving, but it can lead to accidents that can be attributed back to distracted driving and end in a citation. These can also be considered careless or reckless driving under certain circumstances.

Motorcyclists are even more at risk on the road when it comes to distracted driving. A motorist-motorcyclist accident poses greater damage inflicted on the motorcyclist since there is so much less security for them while traveling. A motorcyclist’s damages sustained by a distracted driving accident can be life-threatening.

If your accident resulted from the other driver’s negligence, you may be entitled to compensation for your injuries and losses, including:

  • Medical Expenses – This includes all medical care incurred directly due to the accident (including ongoing/long-term care) such as ambulance trips, assistive medical devices, emergency room treatment, medications, and nursing care, and rehabilitative/surgical expenses.
  • Lost Wages – Includes income you would have earned if you had not missed work to recover from the accident, and may also include future lost wages if you cannot return to the same job you held prior to the accident.
  • Pain and suffering – You may be entitled to compensation for physical and/or psychological pain and suffering which resulted directly from the accident.

  • Wrongful death – If a motorcyclist dies in an accident due to another driver’s negligence, the motorcyclist’s family may file a claim on his/her behalf under the Illinois Wrongful Death Act.
