Who is First PREMIER Bank?

First PREMIER Bank is a bank based in Sioux Falls, South Dakota. Founded in 1999, it has been accredited by the Better Business Bureau (BBB) since 2007.

First PREMIER Bank is privately-owned and maintains 17 locations in South Dakota. It also offers its own credit card, the “First PREMIER Bank MasterCard,” as well as a “Secured Credit Card” which does not require credit history and is tailored to consumers with less-than-ideal credit.

First PREMIER Bank’s Address, Phone Number, and Contact Information

First PREMIER Bank is located at 601 S. Minnesota Avenue, Sioux Falls, SD 57104. The customer service telephone number is 605-357-3000 and the main website is www.firstpremier.com/

First PREMIER Bank Lawsuits

If you want to know just how unhappy consumers are with First PREMIER Bank, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by banks and big businesses. While it can be difficult to get a fair chance in arbitration, the good news is we have filed hundreds of credit harassment cases in arbitration, and we know how to aggressively fight these cases against the big banks and businesses even when arbitration is necessary.

First PREMIER Bank Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if First PREMIER Bank violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against First PREMIER Bank.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If First PREMIER Bank took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. First PREMIER Bank, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment from your bank account, the agency must follow certain steps to comply with the EFTA. Did First PREMIER Bank continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report to prevent unnecessary damage to your credit score. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If First PREMIER Bank is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop First PREMIER Bank’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if First PREMIER Bank violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. The FDCPA also has a fee-shift provision, which means the debt collector will pay your attorneys’ fees and costs. If you have a TCPA case against the agency, we will handle it based on a contingency fee and you won’t pay us a dime unless you win.

THAT’S NOT ALL…

We have helped thousands of consumers stop phone calls.  We know how to stop the harassment and get you money damages. Once again: you will not pay us a dime for our services. We will help you based on a fee-shift provision and/or contingency fee, and the debt collector will pay your attorneys’ fees and costs.

What if First PREMIER Bank is on My Credit Report?

Based on our experience, some debt collectors may credit-report, which means one may mark your credit report with the debt they are trying to collect. In addition to or instead of the debt collector, the original creditor may also be on your credit report in a separate entry, and it’s important to properly identify these entities because you will want both to update your credit report if or when you pay off the debt.

THE GOOD NEWS IS…

If First PREMIER Bank is on your credit report, we can help you dispute it. Mistakes on your credit report can be very costly: along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or even being a victim of identity theft. If you have a mistake on your credit report, there is a process to dispute it, and my office will help you obtain your credit report and dispute any inaccurate information.

REMEMBER…

If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (FCRA), you may be entitled to statutory damages up to $1,000, and the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision, which means the credit reporting agency will pay your attorneys’ fees and costs. You won’t owe us a dime for our services. We have helped hundreds of consumers fix inaccurate information on their credit reports, and we’re ready to help you, too.

Can First PREMIER Bank Sue Me?

Yes, First PREMIER Bank can sue you. First PREMIER Bank can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. If you’ve been sued by First PREMIER Bank, do not ignore the lawsuit; you may have defenses. If you ignore the lawsuit, the default will be entered and the agency may seek to garnish your wages. If you receive notice of a lawsuit, contact an experienced attorney as soon as possible, even if you intend to represent yourself pro se. If First PREMIER Bank has threatened to sue you, call us at Mike Agruss Law as soon as possible; we’re here to help.

Can First PREMIER Bank Garnish My Wages?

Yes, if First PREMIER Bank has a judgment entered against you. If First PREMIER Bank is currently garnishing your wages or threatening to do so, contact our office as soon as possible.

First PREMIER Bank Settlement

If you want to settle a debt with First PREMIER Bank, ask yourself these questions first:

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will First PREMIER Bank remove it from my credit report?
  5. If I pay this debt, will the third-party debt collector remove it from my credit report?
  6. If I pay this debt, will I receive written confirmation from First PREMIER Bank confirming the payment and settlement terms?

These are not the only things to consider when dealing with debt collectors. We are here to help you answer the questions above, and much more. Whether it’s harassment, settlement, pay-for-delete, or any other legal issue with First PREMIER Bank, we at Mike Agruss Law are here to help you.

Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law.

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery. Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

  6. Are mistakes on credit reports common? Yes! Are you one of the 40 million Americans that have a mistake on their credit report? Mistakes on your credit report can be very costly. Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft.

  7. What do I do if I have a mistake on my credit report? If you have a mistake on your credit report, there is a process to dispute them. My office will help you pull your credit report and dispute any inaccurate information. If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (“FCRA”), you may be entitled to statutory damages up to $1,000.00, plus the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision. This means, the credit reporting agency pays your attorney’s fees and costs. Therefore, you will not pay me a penny for my time. To speed up the process, please get a free copy of your credit report at www.annualcreditreport.com. We have 3 credit cards with first premier. All 3 accounts were closed with no notice or explanation. Cant get anyone on the phone and when I send a message through the app they tell me to call. I owe the cards and have paid faithfully every month, yet they closed accounts. They are still charging us yearly fees and monthly maintenance fees but won't let us use our cards This is unfair. Can they just arbitrarily close the accounts and still charge us fees?

First credit bank has been reporting on my credit for years in which I’ve written them several times that account does not belong to me. I’ve sent dispute letters asking them to prove this is my account to no avail with them either responding account is valid or that they do not have to validate. This account has impacted my account for several years.

Hi Barbara. Unfortunately, credit card companies can close your account at any time for a few different reasons, including inactivity, delinquency, loan payment or refinancing, or an issue with a credit bureau to name a few. Have you used your cards within the past year? Can we talk in more detail? Please give my office a call at 312-224-4695. Thanks, Mike

I found your site searching First Premier Bank. I just filed a complaint with the BBB because I got nowhere with calling them or their "collection agency". A couple of days ago, I received a scanned letter from an attorney I had used 2-3 years ago. It was from a collections agency called Jefferson Capital. I had no idea what this was for or about, but it did list First Premier as the original creditor. I called JC, told them I had no clue what this was for and wanted this removed as soon as possible, and they referred me to First Premier Bank. I called First Premier Bank, who took nearly 5 minutes just to find the account I was referring to. The representative plainly stated this does not look like its yours, let me get my supervisor. The supervisor said that it was valid, provided no reasons or could tell me nothing about the account, other than I could "write a letter" or I could call to have JC remove (who I had previously called and they did nothing". This has been affecting my credit for years, and I want them to rectify the situation. My report has accounts with many inaccuracies on them (payments don't line up, open/close dates don't line up, the list goes on and on. I was looking to see what your firm might be able to help with. I appreciate your time. Happy holidays!
Michael Agruss
Hi Kyle. Happy Holidays to you and your family as well! So, it looks like this is an older debt with First Premier Bank, if I'm correct. The letter they probably want you to write is a request for a debt validation. That will provide you with the name of the debtor (First Premier Bank) and the amount you owe. Then you have 30 days to dispute the debt or the debt collector will assume it is legitimate. If you dispute this debt in writing, the debt collector must then provide you with written proof of the debt. I would recommend that you send all correspondence as certified letters as this gives you record of the letters being delivered. I would be happy to speak about this in more detail with you and I will reach out to do so. You can always contact my office at 888 572 0176 as well. Thanks, Mike

First Premier Bank has been on my credit report as a charge off since 2017 & I have had difficulty getting this disputed off my credit. I’ve questioned the validity & they tell me as the original creditor that they don’t have to validate it. Their only proof is an online application & they have attached my current address to the account they’re saying I allegedly opened. The credit bureaus have verified this for 2 years & I’m beginning to believe that they’re not investigating anything on my credit because they are continuing to verify inaccurately reported accounts. I want this off of my credit & hope that you all can help because I’m suffering emotional stress at the moment because I’m trying to start my real estate business & keep getting denied for credit

I keep getting phone calls from people saying they are pursuing legal action against me and will have someone serving papers to me. I know they are never going to do that, but it gets really old. They are saying I am in breach of a contract from 2014. The calls are always very aggressive but I've learned they are not really going to do anything. Is there anything I can do? The biggest issue I see with trying to take action is that we may never truly be able to track them down... Please email a response as I am not always able to answer.
Michael Agruss

Hi Brian. Debt collectors are notorious for threatening legal action and never following through. In fact, if they do so, they could be violating your rights--the law requires them to follow through if they threaten it. How aggressive are these calls? What are they saying? Do you have a call log or recording from these calls? Please feel free to email that information to me at [email protected] and I can review it and then contact you. Thanks, Mike

My complaint is against First Premier Bank. I live in North Carolina where there is a law that prohibits companies from attempting to collect on debts if they do not have a surety bond filed with the North Carolina Secretary of State's office. I have proof that First Premier Bank violated this law, as well as proof that they actively attempted to collect on the debt after the sold the debt to a collection agency. In addition to their violations of the FCRA as well as North Carolina General Statute Chapter 58, I received correspondence from their President's office implying that I'm being dishonest by disputing their credit reporting. Is this something Arguss Law Firm can help with?

Hi Angel. I may be able to help you and I will give you a call to discuss your situation with First Premier Bank and the subsequent claims you have against them for attempting to collect on a debt that may be in violation of your rights. I look forward to speaking with you soon. Thanks, Mike

I lost my job due to COVID in 2021. I owed First Premier Bank 675. I started paying them $100 a month as soon as I got a new job (by then they added fees so I owed $1075). I paid $400 then they blocked my online acct so I couldn\'t make payments anymore. Reported that I still owed $1075. I disputed it and won and they corrected the amount. Their collection agency contacted me and offered to settle the debt (pay to delete) if I paid 50% of what I owed. I paid them $337. I called First Premier to confirm after the payment was made and they told me it would be updated but it takes a while. Now they\'re still reporting it as a charge off. Sent me a letter saying they will report it as a charge off paid and settled for less than what was owed and that certain bureaus may say different things. That is not what I agreed to. Why would I agree to pay half of it to stay on my credit for 7 years and damage my credit?! The collection agency was never once listed on my credit report. I could never even see First Premier Bank on any of my credit reporting apps because apparently they were reporting to Transunion and Transunion won\'t allow me to view or request my credit report online or dispute anything now for some reason.

I have a closed account from First Premier that say it had a $600 credit line and had an amount of $800+ when closed. I believe we forgot about this debt and when we moved we don’t remember receiving anything in the mail. We would like to do a pay to delete but after research on this company they have some terrible reviews. I keep searching for information and education on this and I keep seeing your website. I believe I have been here 5-6 times today before sending this email. Is this something I should consider or something that you may be able to help navigate. Thank you.
