What Complaints Have Been Filed Against SPP Inc?

Consumers have filed complaints against SPP Inc through the Better Business Bureau (BBB) and at least one legal case. A total of 99 consumer complaints against SPP Inc were closed by BBB over the past 3 years. In the past 12 months alone, 73 complaints were lodged against them.

The case of Davenport v. Capio Partners argued that SPP Inc was violating the FDCPA related to credit reporting. The plaintiff believed the debt collector’s credit reporting actions were not permissible since they paid their bill before it went to collection. The court ruled in favor of the debt collectors, and the case against SPP Inc was dismissed.

What Are My Rights if SPP Inc Contacts Me?

If SPP Inc contacts you about your debts, it’s important to understand your rights. Consumers are protected from debt collection agencies by many federal laws, including:

  • The FDCPA

The Fair Debt Collection Practices Act (FDCPA). The FDCPA protects individuals from deceptive, abusive, or unfair debt collection practices. Under this law, a collection agency is not permitted to contact individuals between 8 p.m. and 9 a.m. local time or communicate with them at their place of employment. It also prohibits communication with the individual if they have hired a lawyer to handle their case.

  • The TCPA

The Telephone Consumer Protection Act (TCPA) prohibits the use of automatic telephone dialing systems, more commonly known as robocalls, without your consent. Collection agencies must immediately identify themselves and the reason for their call.

Under the TCPA collection agencies cannot:

  • Auto-dial a landline or cell phone
  • Contact you by cell phone in any way without your written permission first
  • Text your phone before they have your consent to do so

There is a five-year statute of limitations for open-ended, oral, and unwritten debt agreements. A ten-year statute of limitations applies for debts with promissory notes or written agreements.

A debt collection agency like SPP Inc may contact you by phone or mail in an attempt to collect your debt or develop a payment plan with you. If they are unable to reach you or you are unwilling or unable to pay your debt, they may file a lawsuit against you in court.
