Who is Barclaycard?

Barclaycard, owned by Barclays, is a credit card and payment service provider based in London, U.K. Founded as a charge card in 1966, it became the U.K.’s first available credit card the following year. Barclays is not recognized by the Better Business Bureau (BBB).

Barclaycard Lawsuits

If you want to know just how unhappy consumers are with Barclaycard, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by banks and big businesses. Barclaycard Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Barclaycard violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Barclaycard took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Barclaycard, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Barclaycard continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Barclaycard is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Barclaycard’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Barclaycard violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. Can Barclaycard Sue Me?

Yes, Barclaycard can sue you. Barclaycard can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. If you’ve been sued by Barclaycard, do not ignore the lawsuit; you may have defenses. If you ignore the lawsuit, the default will be entered and the agency may seek to garnish your wages. Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt.  Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often to do to violate the law.  

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means, either the other side pays your fees and costs, or we take a percentage of your recovery.   2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks are not bound by the FDCPA.

We both had a Barclay's credit card years ago. We used Money Management International to manage our debt. Barclay's was the only card that would not work with us. We paid monthly through MMI and Barclay's continued to double and triple the debt owed. We recently completed all our payments with MMI and paid all out debt off except for Barclay's since the debt went up so high. They call several times a day, automated to work and cell phones. When it is a person they do not leave messages. We asked them to not call at work yet they continue to do so. The debt is so high now we stopped paying them.

this number keeps calling me leaving me no messages. so i looked up who it might be and it sayd barclay collections. im already paying with american debt solutions. im paying my debt thru a american debt consilidations. this number keeps on calling my phone 8664723850. should i just tell the lawyers at my consildation dept that it looks like they keep calling me. they stated to me that they sent everyone a letter!

Barclay Bank calling me from unknown number on my cell number for some one that I do not know or have any association with I also beleive its like robo call. I told her not to contact me and terminate the call since she has no permission to call this number and she kept going and going asking me if I am Sarkiss Abassi and I kept telling her terminate the call and do not call me.She kept asking me who I am and I told her I am not going to answer any of her question and i want her terminate the call because she is harrasing me.she told me she is recording the call and I told her she has no permission to record the call and she was going on.I told her I will sue barclay bank in court and she kept going and after approximatly 6 or 7 minutes of harrasment she hang up. Since then I was in so much in emotional distress because of Barclay bank representative calling my private cell number for some one that I do not have association!

I bought a MacBook with Barclays in January 2016. I was making minimum payments or more every month until I fell on hard times. I would pay increments of the minimum payment to at least pay something, but then they would add a late fee, making it impossible to catch up. I communicated with them several times, asking if there was some sort of payment plan available and they told me nothing was available for me and that the late fees would keep coming. At a certain point, I just stopped paying because the minimum payment would be too high. I have already appeared in court for this dispute and they didn’t show up, causing the judge to dismiss the case. Now they are suing me again while I am in school. I am a full-time college student and a full-time employee. I pay for school and everything else myself. I barely have $50 to my name after I pay all of my bills and the constant harassment about this has been almost unbearable. They have called me time and time again even after I told them I can’t pay it. They have even went to my mother’s house to find me. I’m not sure what I can do about this since I can’t afford a lawyer but I hope you all can help me.

I am being taken to court by Barclays Bank. I know I have done wrong by not making payments and they are going to garnish my wages. I want to stop that and see if I can make payments from here on out since I just recently got a new job. I used that credit to pay for school and I learned that was a huge mistake. 10 to 12 years ago we paid off the dept, then they said we owed interest, paid that too. Then they said we owed more interest so we paid over the amount! Every couple years the phone calls start again, now there threatening court and judgements against us, this seams like embezzlement to us! Just want it to stop!

I was called by a service company trying to deliver a document to my apartment. They had the wrong apartment number. They had me call 888-685-6326, where I talked to Lionel Molina who said he was at Bayside & Brooks in Tampa, FL. I gave him reference number 2020-198-552 Gi given to me by the service company. Mr. Molina said that Barclay's and Juniper Bank are suing me for credit card debt of $5,652.93 cents. Mr. Molina had my correct apartment number and my SSN and birthday numbers. If I ever had a credit card from Juniper it would have been back in the 2002-2009 range. I have not had any contact from Barclays or Juniper that I recall, certainly not since 2008-2009 when I settled other card debt I have. I currently have several cards I am currently paying regularly and my credit rating is 700+ according to one card statement that includes my rating automatically without a request. Juniper or Barclays must not be on the rating services related to me. I either never had a card with them or it is so old it is past a decade since. Please advise. Thank you.

Hi Jennifer. Do you have a record of Barclay calling prior to 8am? Debt collectors are not permitted to threaten consumers and if they are doing so, they could be violating your rights. Hi - My name is Mariana. I hold a Barclays Credit Card account ending in... After being 60-90 days delinquent on my payments, I called Bayclays and entered into a settlement agreement with them on May 11, 2022. However, somehow I still received a letter dated May 11, 2022 from a debt collection agency, Capital Management Services, LP. Please note, the collection letter is dated on the same day I spoke with Barclays to enter into a settlement agreement. Below is an exact timeline of my issue: 1. BARCLAYS: May 10, 2022, I called Barclays and agreed to a Settlement Agreement to pay the account in full in three installments. I agreed to have these payments automatically deducted from my bank account electronically. 2. BARCLAYS: received a letter dated May 11, 2022 by mail confirming my authorization to deduct funds from my bank account monthly. 3. CAPITAL MANAGEMENT SERVICES, LP: received my first collection letter dated May 11, 2022 for my Barclays account ending in. 4. BARCLAYS: received a Settlement Agreement Letter dated May 12, 2022 by mail to confirm my conversation with them about the settlement and lists out the terms of the settlement. 5. CAPITAL MANAGEMENT SERVICES, LP: On June 8, 2022, I sent out a dispute letter in writing by mail to this debt collector to request for more information and details on this “debt”. I sent it out by certified mail and with tracking. I have not received any collection calls. Capital Management Services, LP does not appear in my Credit Report. I have copies of all documents ready to be sent, Please let me know if you need any other information. Thanks, Mariana

Free consultation-Hi I had a Barkley’s Credit card that was issued thru Wydham timeshare sales 2022 I feel was fraudulently executed along with a Wydham line a Comediety bank line of credit. In which I found out later . I attempted to try paying the debt. After no help from discussion with the cc company nor timeshare exit dept. During Covid I was furloughed from my job an lost my 2nd job a mother at that time. Who also helps with my bills . If needed . Couldn’t afford to continue paying any of it I let it go . It went in collections. Then charge off..& messed up credit score. Now they are trying to sue for 4530.41 with zoom pretrial conference mediation scheduled for April 10 2024
