Who is BBVA Compass?

BBVA Compass – originally known as “Compass Bancshares” before being acquired by BBVA in 2007 – is now known as “BBVA USA” and is based in Birmingham, Alabama. Founded in 1964, it is not accredited by the Better Business Bureau (BBB).

BBVA Compass, the 30th-largest bank in the U.S., is a subsidiary of Banco Bilbao Vizcaya Argentaria (BBVA) and operates primarily in seven states: Alabama, Arizona, California, Colorado, Florida, New Mexico, and Texas.

If you want to know just how unhappy consumers are with BBVA Compass, t ake a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. BBVA Compass Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if BBVA Compass violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If BBVA Compass took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. BBVA Compass, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did BBVA Compass continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If BBVA Compass is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens with an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop BBVA Compass’ debt collection. We will send a cease-and-desist letter to stop the harassment today, and if BBVA Compass violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. Can BBVA Compass Sue Me?

Yes, BBVA Compass can sue you. BBVA Compass can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs.   3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide its citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

I was scammed by a financial analyst, who referred me to a BBVA lawyer. The lawyer has repeatedly asked me for a deposit and has not sent me any money. I paid more than $10000 to the lawyer. However, he is demanding another $8200. I am very distressed because the bills are piling up. I have no money to live on and my heart hurts so bad. Please help me.

We were just discharged from a Chapter 13 bankruptcy. We paid 100% of the debt that we owed at the time of filing. One debt was for a used truck that was financed by BBVA. Now that the truck is paid for and the bankruptcy discharged, BBVA has now put a derogatory remark on our credit report indicating "Paid in full - charge off." This comment reduced our credit score by over 100 points. Is this legal? Can my other creditors now do the same? We have worked so hard to pay these debts off at 100% and it is devastating to see that the creditors can still attack us through the back door, ruining our decent credit score AFTER we have paid them off.

Hi Cathy. Unfortunately, it is legal for that type of information to be reported on your credit report even in the event of a bankruptcy where you paid off the debt. You can work on improving your credit score and wait for the negative information to "fall off" your credit report, which can be between 7-10 years. There aren't many quick fixes for this type of thing, however newer legislation may mean that some previously reportable issues won't be as visible on your credit report in the future. I need to file a law suit against BBVA but not because of harrassing phone calls. SOmeone opened a fraudulent account at BBVA and deposited and withdrew $5,000. I am on SSI/Soc. Security and SS now believes this money put me over my limit for eligibility and effective June, 2021 they are going to start deducting $95 from my monthly benefits. I contacted BBVA about this one year and two months ago in March 2020 and was told I would receive email from BBCA so I could verify my ID, etc. I never did. I have wasted countless hours on the phone with their call center. I have been lied to that an "investigation was pending" when no investigation was being conducted at all. I know this, because I only finally made direct contact with the woman supposedly handling my case, and I only uploaded my ID paper work three days ago. I need verification from BBVA about the status of this account so I can provide it to Social Security! They refuse to provide me with this information. Although I have submitted my ID to them, I have lost all belief that they will actually conduct an investigation and respond to me in a timely manner. If you cannot handle this case can you please refer me to someone who can? I live in El Dorado County, California. Thank you.

I have an open auto loan with BBVA. My loan was deferred due to the Pandemic. My loan fell behind a couple months once the deferment ended. I started making payments to catch up and after every payment with the customer service department they confirm that the payment being my account current. However I received reports from the credit bureaus that my account is 30 days late. I requested a ledger/statements of my balance in person at the branch’s and over the phone. Nothing was received because apparently they had my address incorrect after I changed it with them month and always confirm my details at the start of the call. My balance is incorrect with the credit bureaus. I disputed this information to only be told that it’s accurate. What are my next steps to have my information updated accurately and have those reporting updAted?

Background: My account was in bankruptcy due to divorce and cancer since 2018 and paid as agreed. Additionally it was current prior to filing bankruptcy. My bankruptcy was dismissed during 3/2020 (beginning of pandemic). I called/ emailed BBVA 3/27 /20 when I learned of my dismissal. I was told to pay $30K only no payment or settlement options and to call back in 6 months.  I have tried to get resolution on this matter since that time. I have been given different information by each person I talk to.  Additionally, my car has been listed as a charge off on my credit since filling the bankruptcy in 2018 so assuming BBVA has received some sort of payment on my vehicle and this is just a third-party collection agency attempting to collect on the same debt twice. Further, BBVA is not listed as a lien holder for my car on my registration; on 6/2/21 Liz stated  BBVA filed as the lien holder on 5/28/21 2-days after speaking with Anthony, BBVA Recovery. I am not sure what’s going on but I would like some clarification.

I just received an certified letter from the Toledo Ohio Municipal court notifying me that BBVA compass is suing me for $10,900. I have 20 days left to respond. I would like to stop potential garnishment and work something out.
