Flexshopper Lawsuits

If you want to know just how unhappy consumers are with Flexshopper, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. Flexshopper Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Flexshopper violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Flexshopper took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Flexshopper, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Flexshopper continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Flexshopper is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

We will send a cease-and-desist letter to stop the harassment today, and if Flexshopper violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. Can Flexshopper Sue Me?

Yes, Flexshopper can sue you. Flexshopper can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law. 

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery.   2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

I have been contacted by a local process server that Franklin and Stewart law firm is suing me on behalf of flexshopper for a debt they claim I opened in 2015. I was going through cancer treatment at the time and don't know who flexshopper is but they even had my brother called and harassed over it.

Hi Tanya. Flexshopper is not permitted to call your friends or relatives to harass them. That is a direct violation of the FDCPA. What did they say to your brother? Flexshopper has just taken double the payment twice within the last 3 days from my savings account that they don't have authorization for. I have been getting non stop robo calls from them that I also had to block on my cell phone.

Hello, I have an account with flex shopper and due to covid I was not able to make payments, so I contacted them, and I explained them my problem they agreed to accept my payments of $60 but now they take the $60 but also try to get more than that like $150 which is not what we agreed. Also there’s a man trying to collect money from me, but won’t tell me who send him, and sent me a document saying I might have to be prosecuted in the court house and the only debts I have is my credit cards, they’re in good standing so there’s no reason why they would be emailing me to collect and flex shopper. I never had problems with the law and i don’t know what to do.

I had a flexshopper account in 2014 I feel behind on payments after my partner lost his job and I became the only breadwinner. I expected for it to appear on my credit and honestly forgot about it over the years. I am Not denying that I owe however I haven’t heard from them since 2014 and just last week my mother amd 2 of my sisters received calls from an agency telling them that I was going to be picked up by the police if I didn’t call and settle a claim for a debt I owed. My mother just had a heart attack so uih can imagine her stress level after reviving a call that her child would be picked up from the police. What can I do ?

Hi, I've been a Flexshopper since Oct. 1, 2021. It seemed like a good gig for me because I'm trying to grow into a musician. I ordered a pretty decent guitar and a guitar case that I love. Well, they didn't try to charge me the week after I got it. And I didn't get any calls or notices that I missed the next payment, but when I started aggressively calling them wondering by the way I didn't have access to my lease on the app, nor was I able to login to the website, and neither was the lease still true to its original form when I did see it. Now it says that the debt has been dropped. I looked up MI GNTYAGNCY from my new credit score I got today. It dropped 6 points. Not to be fashioned as a tool, I understand because this is a shoddy business IMHO and doesn't get that a schedule is a schedule and a contract is inalterable. Finally they took two different amounts from my account on Friday, plus another. 2 of those were regular payments. The third was out of nowhere. I'm up to date on that item. Last note, any company that cannot keep track of their own paperwork should not be allowed to handle people's money. Contract terminated in my eyes. Am I in the right, Mr. Agruss?

Hi Natisha. Nobody collecting on a debt is permitted to threaten legal action unless they fully intend to use that as an avenue for collection. This is common practice for debt collectors and the law protects you from this type of harassment. They are also not permitted to contact your friends or family and divulge any personal information about your loan. They are only permitted to request accurate contact information for you, and if they have threatened you or your family, they could be violating your rights. I used flex shopper thru a pawn shop and they took a double payment my payments was 11.00 each and some change for 2 items they charged me 60$ and something and ran my account negative, now they keep calling me and threatening to take me to court bc I do not want them taking anything out my account bc of the double payments.

A few months ago I tried to close my account with Flexshopper because the kept overdrawn my bank account. When I post to been calling my payments in .. pay them up so I didn’t owe them any money and asked for a refund so I could return their merchandise .. the toll me I will have a refund will in 7 business days and then turn around they started calling me about I have late payments … so the problem is how can I have late payments when you post to been giving me a refund??

I’ve noticed I have been getting a lot of calls, that do not say who the person is or what the company is. They leave voice mails DAILY telling me to call a number with a reference number. I get a lot of calls during my work hours and it’s insane how much is it to the point I have to mute my phone so it goes to voice mail. As for Flexshopper, I feel behind on payments I called them to ask about a payment plan $50 bi-weekly. But they said I can only do that for two weeks and they would up the payment to more. Which I told them I cannot afford to pay more. Since I have other bills and get paid bi weekly and have a finincal hardship. But they didn’t seem to help out at all. And told me I need to Email collections I don’t know what to do about my debt. And not only for flex shopper but in general.

I have used flex shopper for a couple years now. They are numerous lot taken double Payments out of my bank account. I’m laid off now at my job and they refuse to help me with my payments. What can I do?

I mistakenly used flexshopper for a computer I wanted and after making months of payments that total up to a little over a $1000 I noticed that the lease detail says I still have over $1200 left to pay even though the computer is barley over $1000, so they are overcharging me double for this computer along with constantly taking out unauthorized payments without any notice, and spamming me with emails and texts and sometimes calls while I’m at work. They are a very shady company and I want to get this dealt with asap.

I used flexshopper to obtain tires and wheels. I lost my job shortly after that. Once I started working again I called them to set up a payment arrangement. They pressed me hard for banking information and a good faith payment. After the arrangement was made , flexshopper went into my account without authorization and took a payment before the arranged time, causing issues with my bank. I contacted them and they said they knew nothing about an arrangement. Then they did find arrangement agreed upon said they would return my money and they did not. I had to change my banking info, so they don\'t have access to my account,. They constantly call my phone all day long to point I had to block my phone, but I can\'t keep up with the robocalls. I tried to work with them, but lied to me and stole money from my account. I need help!

I have had many issues with Flexshopper. They have called and said I had a past due balance and if I paid would be up to date. Within minutes of paying I would receive another call saying that I had another past due balance. This happened on several occasions. Also, I was admitted to the hospital 4 months ago and was just released last week. I fell way behind on my bill but was able to pay 90$ last month and explained that I would let them know when I could pay more. My original payment was scheduled for a one time payment on every Friday. In the past 2 weeks they have taken 2 payments each week without consent ontop of calling me no less than 5 times a day. And last, I paid off my first item purchased from them early, about a year ago. After paying it off and being told my balance was zero they called me and said I still owed a balance on that closed account. I am pretty sure I have a case.

I have been unemployed twice within the last year, Flexshopper stated that I had a protection option to save my lease from going to collections if I sent them my unemployment paperwork, now they said they can\'t find the documentation I sent, and if I don\'t pay them almost 600$ next month they will take legal action against me. I can\'t afford to pay this amount, I offered to return the device I originally purchased through the lease program and they didn\'t want to accept the return even though the device is in perfect condition to this day. I just spoke with my bank today. While reviewing my account (BOFA), I discovered that Flexshopper has been accessing my account without any \"authorization\" from me. I don\'t normally, review my on-line bank, but decided to today is when I discovered they were taking fujnds out since 2022 according to the Bank. I NEVER remember ordering anything from them and do not know who they got access to my account because I didn\'t give them permission. Anyway, Bank of America has filed a claim. I trying to get all my funds returned.

We don\'t owe them anything!!! They some how gained access to our BOA account for almost 11/2 years. We discovered this once begin to monitor the account closer via the BOA app and saw this company whom we\'ve never done any business with taking a fee out of our account. We talked to BOA and they filed a fraud complaint and researched this company. We called as well and asked them why and how are you taking funds from our account from a \"bogus\" purchase/lease we never signed for or received? We don\'t have any type of product ordered from them and we asked them what \"address\" was this product sent to and what was the product because we don\'t have anything received or given approval to anyone. They couldn\'t and didn\'t answer our questions; nor did our bank\'s research prove anything? So, we are a place that we need a valid legal company to address and to validate this company. It is totally fraud without any validity. The amount from what I was told taken was around $1,700 over a 1 1/2 to a 2 year period. We want our funds back and want them to be sued for their fraudulent acts and privacy issues related to our account.. Can you please HELP and also be credible and fair in your possible assistance with this issue?

Flexshopper says I owe them $2400 for 6 items I bought from them. They tell me I have until March 19 to pay them or they will take legal action against me. I told them I could pay them $100 a month, but they said I had to pay them in full. I don\'t have that kind of money. I am on SSI.

I gave flexshopper my debit card number thinking they would take $100 out of my bank account on March 1 now I am afraid they will take $2400 out on March 1. Right now I can\'t afford for them to take any amount out of my bank account.

I have tried calling, flexshopper has seem to breach there own contract and ive been asking them to please fix there contract as they breached it and now they are changing the contract and without approval and still will not own up to it or fix it
