Fortiva – also known as “Fortiva Retail Credit” – is a credit program offered by the Bank of Missouri. Fortiva’s parent company is “Atlanticus Holdings Corporation,” which is based in Atlanta, Georgia.

Fortiva Lawsuits

Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. Fortiva Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Fortiva violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Fortiva took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Fortiva, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Fortiva continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to? If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Fortiva is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report. 

Several states also have laws to provide their citizens with an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

We will send a cease-and-desist letter to stop the harassment today, and if Fortiva violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. Can Fortiva Sue Me?

Yes, Fortiva can sue you. Fortiva can hire a lawyer to file a breach of contract lawsuit against you for the underlying debt, fees, and costs. Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often to do to violate the law. 

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.   3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

Due to the events caused by Covid19 I accept an arrangement with Fortiva over the phone. Fortiva agreed to delay my payments , waive late and over limits fees for March, April and May. However, over the last few weeks I've had to contact them regarding the fees. Some of the fees are being waived, but not all and that was not the agreement.

Paid for a purchase to Guitar Center that was never delivered. The purchase was canceled but the the fund have not posted as returned so I have a charge of 1000 on the fortiva card despite having several calls with the fortiva team and guitar center on the line. They are requesting I file a dispute but this is clearly a error that I should not have to make payments for.

I ordered a motorcycle vest using my Fortiva card. Fortiva texted me that there was unusual activity on my card and had me call their fraud dept., which told me the transaction would not be fulfilled because they didn't trust the website. I said, "fine" and told them on a recorded call that I would order it somewhere else, which I did. The next week Fortiva approved my original order, the one they told me they wouldn't honor and I was stuck with two bills for about $150 each. I received both vests and tried to return the original order but can't get ahold of the merchant and Fortiva says that they are not responsible. I paid off the card despite being ripped off. Do I have any recourse to getting my money refunded?

Fortiva is refusing to close my Wife's account and continues to charge her "fees" and late fees on top of those "fees. This is after them verbally confirming that the account has been closed at her request. This has been happening over the last two years. It is effecting her credit score and causing us significant distress, why can't we get her account closed?? This seems to be deceptive and a deliberate attempt to keep her account open in order to continue charging fees. I've never seen a bank or credit company behave like this before. Please help

On or about November 2017, I "allegedly" applied over the internet for a TBOM/ATLS/Fortiva credit card. I have no knowledge of this. I do have knowledge of several security breaches at that time which resulted in my credit being hacked and identity "stolen," resulting in a number of erroneous and fictitious activities occuring. ALL others have been resolved with this lone exception. TBOM/ATLS/Fortiva claims to have "charged off" this debt sometime in early 2018. I have not received any communications or debt collection attempts from them since I put them "on notice" in early 2018 of the issue. Now, however every month since September 2021 or before, TBOM/ATLS/Fortiva schedules this "account" for charge-off. I have disputed this action 3 times previously and filed a "fraudulent account" dispute with Experian. Experian has been successful in only temporarily having the phantom "Charge-offs" removed temporarily only to have to go through the same process every 30 days. Experian states that TBOM/ATLS/Fortiva "authenticates" the account as real (really?????) but adjusts the account "charge-off" status (until we go through the same process again the following month.) These phantom, monthly charge-offs have had a devastating impact on my credit report with Experian. I have not reviewed the reporting impact with TransUnion or Equifax. My credit swings between 706 and 636 each month on Experian due to these repetitive and phantom "charge-offs." Frankly I am done messing around with this. I am contemplating filing a complete with the FCC(CFPB) but I thought I would seek a debtor attorney's advise first. It appears to me that TBOM/ATLS/Fortiva has committed repeat violations of FCRA. Since they have never communicated directly with me since early 2018, there have not been any violations of state or federal collection laws that I am aware of.

I moved and I installed a vivant home security system and I setup autopay. I was unaware that vivant and the equipment were two different payments. After a few months I received an alert on my credit report that i had 3 late payments. I have a 750 credit score and i was confused. I called the phone number on my credit report and they told me about the account for the equipment and how its a separate payment from service. I paid the equipment in full (almost $1600) right then and there. the company said they would send a deletion letter and never did. the first few times i called they said they were taking care of it with the bureaus and in the last month they are now telling me they dont do deletion letters.

A fortiva credit was approved in my name and despite informing of them of the possible fraud they continue to call me almost 20 times a day, sometimes as early as 4:00am and as late as 10:00pm.

Hi Nia. If you suspect that you are dealing with an identity theft case, you will want to follow a few steps to protect yourself and your credit. These include: notifying the affected creditors, put a fraud alert on your credit report, check your credit reports, freeze your credit, report the identity theft to the FTC, contact the police, and change your account passwords for all your online accounts. Oh god where do I start! I just got off the phone with Fortiva. Ok for the past few months I have been on their credit protection plan and they were paying the monthly bill. During that time I noticed that on my credit report that my Fortiva account was closed and opened. This was repeated a few times. Now they’re telling me my account is closed and reasoning for this is because I missed payments lol which of course never happened. They proceed to tell me about missed payments august of 2021 and because of 4 missed payments they closed it. However, during that time I went through hurricane Ida and was completely displaced. I called them during this time for disaster assistance which wasn’t granted and I had no way of knowing this until 2 months later to check because of no phones or electricity because of storm. July of last year I was had to activate the medical credit protection program due to a cancer diagnosis. Which they approved and to my surprise went back to the missed payments and credited my account. Currently I’m disabled and they are aren’t showing these corrections or payments. So now my account is closed without my permission or notification. Plz help!

8/:l!0/2022 I Marie I had a consult 8/8/2022 @ 11:10-11:20 am. She went over everything, I kept asking about the $45.00 a I month deal that I had seen advertised. I was under the impression that the whole thing would be $45.00 a month. She reached out to the company that provides credit. I was approved for $2000.00 dollars. When I returned to my desk, I received information about a health issue that would not allow me to go forward with this, as well it would be completely out of my price range. I was told on the consult that I had time to back out if needed. So, It is very interesting when there is no response from Ideal Image to address my request. I reached out to the phone number that I was initially texting with Chelsea (see attached screen shot) @12:47 pm on the same day 8/8/2022. (No response) I then reached out to the customer service team at ([email protected]) 8/8/2022 @ 1:50pm (see attached.) No response I With no response I called Fortiva retail credit to inform them that I no longer wish to proceed with this promotion. I would like for it to be cancelled @8/8/2022 1:26pm. It was cancelled (see attached mail) I called the Plano location that my appointment (September) would be at to cancel. I talked to Sara. Today 8/10/2022 I sent another text to Chelsea - no response After all this I received an email on the 2000.00 charge that was place on an account that I had closed. (See attached) This whole thing feels like a scam. When there are no responses and long hold times ending with them disconnecting. 1 I am not asking for a refund as I have not spent any money with this company. Just want the credit to be closed with no possible way to be used again. No cash has been exchanged with either party , appointment has been cancelled. I asked fortiva to restore the funds back to the card due to the unsatisfactory service of the provider they are partners with! I also ask them to reduce the monthly payment they advised me that neither was an option so far I am 3 payments behind and my credit score dropped from 650 to 500 Help I’m depressed from this

I signed up for a Home Depot card at the checkout stand; never received the card, never knew the card number, never received any letter or email confirming the account. All attempts to pay the card with Home Depot failed because they say the account doesn\'t exist! After several frustrating and scary months of trying to pay on the phone, online, at the store, all in vain due to not knowing the card number and no account tied to my SSN; I decided to comb my emails yet again for Home Depot card information. Finding nothing, I checked my text messages (not thinking a card would solely use text messaging for this), and in my \"unknown senders\" found messages from an entity called fortiva. I wouldn\'t have paid attention but the text had \"THD\" on it, making me wonder if that stood for \"The Home Depot\". I went to the link in the text only to find a fishy looking payment page riddled with broken link and offering no balance, just a \"put your card number here\". Not trusting it, I called Home Depot yet again to ask them if their cards were managed by this Fortiva entity. It turns out they are, and so they transferred me to Fortiva, where I found out that over $100 of fees had been tacked on. I said I wanted to pay off the card but given how they failed to send me a card, or proper communications; and since I\'ve been trying to make payments for 7 months (in vain only because I had not been provided with the right information) that I want to contest the late fees. They refused to remove them. This seems unfair and akin to racketeering to me, withhold the information customers need to make payments, whilst they are being charged late fees.

I make my payments early and now there telling me it doesn\'t count as a payment if you use your debit card and make early payment now there trying to charge me a late fee even though my payment was early makes no sense you would think every company would want you to pay early I\'m on social security so I get paid once a month so I pay all my bills

Fortiva has reported my account closed on December 11th now open February 11th after making a payment and speaking with a manager some how my account switched the account status to open/ current although its a closed account, also the way my account closed was predatory I called 3 days before account closed to make payment arrangement, and with no warning closed the account, so they need to be deleted from my credit report because this is illegal and the will reverse the closed account ruining my credit for the second time in less than 90 days which the first time was over 100 points.

Hello, I hope this message finds you well. I do not know if you can help me or if you could guide me in the right direction. We had a Fortiva loan opened by Vivint security systems when we had a security system installed. We have been diligent to pay off the monthly amount to ensure great standing. In fact, we were told in the beginning that we could not increase the monthly payment , that said, it is on a auto payment. What is my concern is that I found out today that Fortiva has opened a credit card without my consent or authorization. This came to my attention when I opened my mail and found a notice that they have issued me a credit card, then I received a number of notifications from Expedia and Life Lock that a credit card account was opened. Is this legal for a company to create and issue a credit card , which triggered my credit score monitoring agencies. I work very hard to maintain a good credit score and try to maintain my identify secured, however, this action alarms me , how could a company open a credit card without a persons written consent? FORTIVA RETAIL CREDIT IS RIPPING ME OFF WHEN i HAVE ALREADY PAID FOR MY PURCHASE AND NOW THEY WANT ANOTHER $1,061.00 ALL INTEREST. i HAVE ALREADY PAID THEM $3322.00 FOR A $1,935.22 PURCHASE .

I have evidence fortiva allowed fraudulent charges after my account has been closed that they have refused to refund me fore. I then proceeded to refuse payment until it was fixed. They then offered a \"50%\" match payment, so when I tried to pay the maximum amount that would close out the account, I recorded that their website actually forces you to make small payments when using this method, eventhough it is advertised I can pay a maximum amount. They have not been helpful and continue to call me to try and collect money without addressing the complaints.

Fortiva was calling my home and has been sending me collection letters and invoices for a debt I do not owe. I\'ve notified them multiple times in writing that I did not incur this debt but they keep sending me invoices. It\'s also been reported to the credit bureau and has drastically reduced my credit rating. I\'ve threatened to sue them and the Bank of Missouri but still received no response. They have been and are continuing to try to collect a debt that is not owed.
