Who is GreenSky?

GreenSky (GreenSky, LLC) is a loan servicer based in Atlanta, Georgia. Founded in 2006, it has been accredited by the Better Business Bureau (BBB) since 2014.

GreenSky is classified as a financial technology company and began as a startup with financial backing from DST Global, Iconiq Capital, QED Investors, TPG, and Wellington Management.

GreenSky Lawsuits

If you want to know just how unhappy consumers are with GreenSky, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by the banks and big businesses. GreenSky Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if GreenSky violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If GreenSky took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. GreenSky, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did GreenSky continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If GreenSky is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide its citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. If you live in North Carolina and are being harassed by a debt collector, you have leverage to obtain a great settlement.

We will use state and federal laws to immediately stop GreenSky’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if GreenSky violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often to do to violate the law.

I was scammed by a company called laser away when I was 18. Green sky has been harassing me ever since. Not only do I not owe a debt, but I don’t deserve to be harassed and asked such invasive questions. They have called me when I have work and during hours I told that I cannot receive calls. They have left countless messages on my voicemail, my Mothers, and Sister’s voicemail— all of which are unprofessional and embarrassing. They have never actually disclosed that they are a debt collector. Until now, I was confused about who Greeksky was and didn’t understand how I could have owed money. I thought I was an 18 year old being totally scammed since I didn’t take out a loan and their calls didn’t seem legitimate, but I now see they’re a debt collection agency who owns my debt to this company that scammed me. It’s very embarrassing that they have told third parties that I owe a debt, especially because I feel I was robbed. I’ve asked them to stop calling me and third parties, but they have not listened to me.

I was scammed by a company called laser away when I was 18. I went to laser away to do a free consultation where I was given what I was told was a gift. Green sky has been harassing me ever since. Apparently, Laseraway took out a loan on my behalf. I don’t see how this is possible, especially because I was told this was free and no one actually told me that they would be taking out a loan on my behalf… If I do, in fact owe Greensky money, I would argue that this was predatory lending. I was only an 18 year old student. From what I recall, I did not even have credit history at the time. I don’t know how I could possibly qualify for a loan! I don’t deserve to be harassed and asked such invasive questions by them, either. They have called me when I have work and during hours I told that I cannot receive calls. They have left countless messages on my voicemail, my Mothers, and Sister’s voicemail— all of which are unprofessional and embarrassing. My husband and I got a loan through green sky (big mistake) . We have made payments until recently due to the pandemic and having money issues . I lost my job and on top of that we are expecting a baby . They would call me 5 times a day just nonstop spam calling. After I picked up the phone and answered them it didn’t stop. I had to change my cellphone number because I was so overwhelmed with the nonstop phone calls I would cry in my bed. My husband didn’t change his number as they could still contact him but instead they decided to call my both my parents nonstop and harass them and tell them about our debt which was very humiliating. They even called my mother in law countless times even though they have my husbands contact information. I feel defeated and humiliated we don’t even know how they got our families phone numbers we are shocked .

I had dental work done in 2017 the dental company submitted a request for a loan by phone and Green Sky responded. I was not made fully aware of how the loan was going to work but apparently it had a period where they did not charge interest. At the termination of the "no interest" time my payment increased. I have been paying the increased amount of $165 per month. My loan principal has not gone down - instead the loan is more than when I took it out in 2017 - I took out $5,000 I owe $5,074.19, even though my payment is taken out monthly by electronic payments. I have contacted Green Sky as well as the bank listed as the lender, Renasant Bank, for an audit report of my account. I have not received a response from either of them. The interest rate is supposedly 29.99%, my payment is $165.06 monthly, the Beginning Balance is $5,130.86 and the interest charge is $108.39 - this same information has been showing on the invoice I receive every month. From 2017 to the present I would think my balance would have decreased. Do you have any advice as to what my next steps should be? Thank you in advance.

My husband was in home hospice care with copd when we had major home repairs uncovered by house insurance caused by a neighbors tree that fell and moved our house just enough to cause flooding under our house. We called a firm call Mr. Fixit and they first checked my husbands fica scores then mine. They were informed that my husband would die within weeks and offered to arrange financing for 6 thousand dollars. They arranged it right in our living room and in the end the loan was approved within minutes and had an interest free period. It ended up being 13000.00 and then 18,ooo.oo after interest. The payments are over $5oo,oo per month for over 5 years. I am 76 years old and will probably not live to be over 80. My husband died 1 month later after am extended amount of time to do the repairs which were not done properly and left dangerous conditions for me and 2 others in my home. "What I thought was kindness and concern turned out to be what I know view as a predatory loan. I want to help make other people aware of this practice and get out from this crushing debt. My Credit is in good shape now except for this debt.

Hi Hannah. I'm sorry that Greensky has affected you in such a negative way, I'm sure it is difficult with a baby on the way. Debt collectors are professionals at getting contact information for your friends and family, and while it is legal for them to contact them, they cannot divulge personal information to any third-parties. They initiated a loan without our consent. The tried to enforce terms we didn't agree to. They wrote off the fictitious loan, and it has greatly downgraded our credit rating. Their nearly constant harassment through phone calls nearly cost us our ability to save our 15 year old business during a pandemic. Their tactics wasted our time resources, and interrupted important calls, and time sensitive business obligations and opportunities.

I believe my elderly mother (78) was targeted for home repairs she didn\'t need. A roofing company knocked on her door and told her she needs a new roof and scared her into thinking she needed it right away. My mother lives in NJ I live in VA. My mother had the roof done without my knowledge. She called me when she got an invoice for $34k, I\'m asking her what\'s going on a lot of it she can\'t remember. There had been months in between signing up for the work and the work being done and receiving a invoice which I think was deliberate. Mind you my mothers house is 1,900 square feet the invoice was for a roof and gutters that is ridiculous. I called the roofing company they were argumentative in the beginning and then quite they didn\'t want to talk to me at all. Months later someone called my mom and asked for her email. She told them she doesn\'t have one and asked my sister for hers. My sister gets an account confirmation and invoice from Greensky for $34k. I called Greensky and adviced them this account was fraudulent. They said sometimes the roofing company will fill the application out for you, they agreed to investigate. They told me the account was valid, they had my moms signature on the application and the account was activated via ipad. I told them my mom doesn\'t have a ipad nor computer how was the account set up? I\'ve request several times to see the application, I want to see the signature. BTW, the signature on the roofing contract was electronic so anyone can do that. My mother doesn\'t remember the verbal communications. She shared the conversation with an aunt after she agreed to get a roof and my aunt said she told her $16k when I asked my mom she said that sounds right. I think that roofing company stopped communicating with me because they filled out that application fraudulently they were paid in full now my mom owes Greensky. I need legal advice on where to go from here. I want to see the application for the loan my mother supposedly completed and signed. Can you help?
