The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Metro Credit Union violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Metro Credit Union took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Metro Credit Union, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. Dear David Varno: I have signed the following disclosure package which I have only gotten very recently. 2022-04-29 10-1 3.25% [email protected] signed 1 I have repeatedly been called by Metro Credit Union and been told my CC charge for $595 to this card has been declined for a CC charge. I had reconfirmed the CC number, name, address, back code with Metro Credit Union. I have been told this CC charge not going through is holding up and jeopardizing my loan, and it may be declined. I have called my credit card (CC) company Credit One Bank visa several times and they have told me repeatedly that there never was a credit card charge for $595 presented at all in the last month from anyone let alone Metro Credit Union. They also confirm that there has always been enough available credit for a credit card (CC) charge of $595 on the CC. I reviewed my online VISA , account and credit card statements in detail and there is NO reason that a CC charge of $ 595 should not have gone through at anytime there has always been adequate available credit. 2022-04-29 at 11:52 AM I called again to Credit One about this ongoing VISA CC charge issue again getting Nick who said there was no attempt at a $595 CC charge in the last month and plenty of available credit. Then at 11:57 AM I was transferred to the supervisor Shawn at Credit One Bank who confirmed who said there was no attempt at a $595 CC charge in the last month and plenty of available credit. David you happened to call when Shawn was on the phone and for the first time I was told by Metro Credit Union may be trying to process the $595 fee as a cash advance. I never knew about, was informed about or authorized a $595 cash advance to Metro Credit Union. Shawn then checked and given I knew this for the first time and Shawn did confirm that Metro Credit Union was trying to process a $595 cash advance on Credit One VISA CC 7796. David Varno then stated he did not process the charge, or know how the charge was processed, but had an internal Metro Credit Union written memo that "proved" my $595 Credit One VISA CC 7796 was "declined". I then had him speak over the speaker phone with Shawn at Credit One VISA who confirmed the $595 "charge" was not put through as a CC charge but rather a CASH ADVANCE and that is why it was not approved. David you acknowledged this is the way Credit One VISA had received the request as a CASH ADVANCE and that Metro Credit Union had done this with other borrowers and had the same issue before. I have received a Metro CU final notice seemingly threatening and jeopardizing my loan. I have lost many days of rate ock trying to understand what has gone wrong, and the opportunity to follow through with other lenders who would not have these issues and not rates are much higher. At this point, after all this trouble I would need Metro Credit Union to agree to take the $ 595 out of the closing costs. I would be happy to pay for the appraiser in advance directly or indirectly. . If this is not agreed to today, then David Varno I would need your supervisors contact information and the at least internal grievance procedure to start.
