Who is Navy Federal Credit Union?

Navy Federal Credit Union is a global credit union based in Vienna, Virginia, and is the United States’ largest retail credit union with over 9.6 million members and $130 billion in assets. Founded in 1933, it is not accredited by the Better Business Bureau (BBB).

Navy Federal Credit Union primarily serves active and retired service-members of all branches of the U.S. military.

Navy Federal Credit Union Lawsuits

If you want to know just how unhappy consumers are with Navy Federal Credit Union, take a look at the number of complaints consumers have made online. Nowadays, most original creditors, credit card companies, etc. have arbitration clauses, which means that if you have a complaint against that company, you must file your claim in arbitration. Arbitration limits discovery, is not public, has a limited appellate process, and, most importantly, is funded primarily by banks and big businesses. While it can be difficult to get a fair chance in arbitration, the good news is we have filed hundreds of credit harassment cases in arbitration, and we know how to aggressively fight these cases against the big banks and businesses even when arbitration is necessary.

Navy Federal Credit Union Complaints

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Navy Federal Credit Union violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Navy Federal Credit Union took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Navy Federal Credit Union, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Navy Federal Credit Union continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Navy Federal Credit Union is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide their citizens with an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Navy Federal Credit Union’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Navy Federal Credit Union violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. The FDCPA also has a fee-shift provision, which means the debt collector will pay your attorneys’ fees and costs. If you have a TCPA case against the agency, we will handle it based on a contingency fee and you won’t pay us a dime unless you win.

THAT’S NOT ALL…

We have helped thousands of consumers stop phone calls.  We know how to stop the harassment and get you money damages. Once again: you will not pay us a dime for our services. We will help you based on a fee-shift provision and/or contingency fee, and the debt collector will pay your attorneys’ fees and costs.

What if Navy Federal Credit Union is on My Credit Report?

Based on our experience, some debt collectors may credit-report, which means one may mark your credit report with the debt they are trying to collect. In addition to or instead of the debt collector, the original creditor may also be on your credit report in a separate entry, and it’s important to properly identify these entities because you will want both to update your credit report if or when you pay off the debt.

THE GOOD NEWS IS…

If Navy Federal Credit Union is on your credit report, we can help you dispute it. Mistakes on your credit report can be very costly: along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or even being a victim of identity theft. If you have a mistake on your credit report, there is a process to dispute it, and my office will help you obtain your credit report and dispute any inaccurate information.

REMEMBER…

If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (FCRA), you may be entitled to statutory damages up to $1,000, and the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision, which means the credit reporting agency will pay your attorneys’ fees and costs. You won’t owe us a dime for our services. We have helped hundreds of consumers fix inaccurate information on their credit reports, and we’re ready to help you, too.

Navy Federal Credit Union Settlement

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will Navy Federal Credit Union remove it from my credit report?
  5. If I pay this debt, will the third-party debt collector remove it from my credit report?
  6. If I pay this debt, will I receive written confirmation from Navy Federal Credit Union confirming the payment and settlement terms?

These are not the only things to consider when dealing with debt collectors. We are here to help you answer the questions above, and much more. Whether it’s harassment, settlement, pay-for-delete, or any other legal issue with Navy Federal Credit Union, we at Mike Agruss Law are here to help you.

Top Debt Collection Violations

Debt collection laws provided a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law.

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery. Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  2. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, oftentimes Defendants pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  3. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens with an additional layer of protection. For example, if you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, and Wisconsin, you have additional state-law rights.

  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

  6. Are mistakes on credit reports common? Yes! Are you one of the 40 million Americans that have a mistake on their credit report? Mistakes on your credit report can be very costly. Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft.

  7. What do I do if I have a mistake on my credit report? If you have a mistake on your credit report, there is a process to dispute them. My office will help you pull your credit report and dispute any inaccurate information. If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (“FCRA”), you may be entitled to statutory damages up to $1,000.00, plus the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision. This means, the credit reporting agency pays your attorney’s fees and costs. Therefore, you will not pay me a penny for my time. To speed up the process, please get a free copy of your credit report at www.annualcreditreport.com. Hi LaShon. Why has Navy Federal seized your money? Did you owe them a debt? Typically, social security funds are not subject to liens and garnishment, however if they are, it could require a court order to have the garnishment stopped. I can talk this over with you when I give you a call. Thanks, Mike

Michael Agruss

Hi Kiara. Typically, your wages cannot be garnished without a court order against you. However, if this happened you, you may want to check on the contract you signed with the Navy Federal Credit Union to read the terms of your accounts. Also, was the credit card through Navy Federal Credit Union or was it from somewhere else? Let's talk more about this--give me a call at 888 572 0176. Thanks, Mike

Good morning, I am cureently in dispute with Navy Federal Credit Union. I have an active cease and desist in place cureently but I am still having some issues with the company. They have restricted my credit card account for the third time for "non Payment" even though there is a cease and desist on the account and they have reported several late payments. In addition, I have indicated a billing error per 15 USC 1666 and requested for them to send me Documentary evidnece in accordance with 15 USC 44. They have not sent the proper evidnece as requested. I recently sent them a notice of dishonor and opportunity to cure. I am aware that my next steps would be litigation, but being that this is my first time doing this, I am a little confused on the process. I was seeking help from a law firm and I came across this comapny. If possible, I would love the help and/ or insight. Please advise. Thank you, Deionca

Hi Jerry. Did they only state that they're planning on suing you, or did the serve you with paperwork of a pending lawsuit? It is illegal to threaten legal action and not follow through, so if they do not serve you with paperwork, they could be in violation of your rights. Let's talk more about the law and your rights--give me a call at my office and we can have a free, no-obligation consultation. Thanks, Mike

My loan officer pre approved me for an amount that I didn’t qualify for. Close to the end of closing on a home, received a denial because of DIT. I have spent over $600 for inspection and ect. Got a second opinion and I was told I was never supposed to be pre approved for that much due to my student loans and car note.

Navy federal has froze my account and place a restriction on my online access. When I contacted them I was told that they froze my account and placed the restriction block on it due to a female calling in 3 times to impersonate me. Navy Federal told me I would need to submit in writing via email a couple of things so they can verify me and give me back access to my account. Those things were my government issued ID, 3 signed signatures, and my marriage license. They also told me in the body of the email I need to state exactly what it is I need, I need to change my code word and provide them with the new code word, I need to provide them with the best call back number, what time I’m available and what time zone I’m in. They told me once they receive this information they will review and give me a call. I’ve never received any call from navy. I spent weeks calling only to be transfer to different reps telling me different things. My Navy account is where my direct deposit from work is deposited. I got paid twice and have no access to my money. We recently had a storm hit us, I called navy to please give me access to my account I’m going through a Disaster and still they did nothing. My account is still block. I have no access to my money. My debit card doesn’t work. I have small kids that were sick I couldn’t even go but medicine for my children. I called asked to escalate my call to supervisors and still nothing. I did research and seen where Navy has been sued for situations similar to what I’m going through this is why I’ve decided to seek legal help.

Navy federal has sent our delinquent credit card bill to Weltmen, weismen and reis. I am currently waiting for debt verification forms from them. I have not received any. Currently navy federal took $398 from my checking account unauthorized to pay towards credit bill. Putting myself and my family in a bind to pay rent, bills and food for my kids. When called they refused to refund the money taken. Refused to set up a payment arrangement. Informed me that they still hold the contract but all concerns and arrangements have to be set up through the debt collector. They informed us that paying $25/month did not meet THIER arrangement of $267/month, so they are seeking additional help through debt collector. They informed me that it is in the contract for the credit card that they can take as much funds as they please out of my account, without notification to pay delinquent fee. Last year, I broke my back and was out of work. I could not afford their demands. They agreed to work with me, but still pulled this, took my paycheck out of my account and now I can\'t afford my bills. I risk losing my home, utilities being turned off and my children going without the necessities. What do I do? I need help.

My wages are currently being garnished by NFCU. The address on the paperwork sent to my job is old. I was never served with papers for a court date. So it went in their favor. They are taking almost $900 from my check when I have four children leaving me less than my rent per check. Is there a way to have the amount garnished adjusted? So far they say I owe over 12K (my car limit was only 10K and when delinquent balance was 9K and change), and I so far have paid over 6k from my wages.

Lawsuit received from Navy Federal Credit Union: debt collection
Dreka

Navy Federal used fraud to obtain a judgement against me. I received a letter from a lawyer in June/July stating that Navy Federal had been awarded a judgement against me. I thought it was strange that I had never been served and knew nothing about the case. I went on the live chat with Maryland Courts and was told that the process server reported serving notice to my home. The problem is that I was in Florida on the date that was on record. The other problem is that the person who received the notice is not known to me and does not live in my home as only myself and my 11 year old daughter live there. They recorded the name Marcell Swann who I have never heard of in my life. My friend\'s son\'s first name is Marcell but he is a minor and does not live in my home. I was told to request a \"Stay of judgment\" but I am not sure how to do so and if it is too late. I can admit that I do owe them money and had fallen on hard times, I even talked to the lawyer about making a payment arrangement (long before the judgment) but she told me that what I was able to pay was \"too low\". But I have a right to be able to come to court in my own defense and to due process. I also feel like something more should be done. Navy Federal should not just be allowed to use fraud and commit perjury and get away with it.

NFCU INCORRECTLY computed my payments from the very beginning of my auto loan which caused several thousand dollars in overpayments, late fees, won’t give me the title, and when I complained RETALIATED by sending my account to collections. Both NFCU and collections fought hard to not give me transaction history. After several formal disputes I FINALLY got the complete transaction history and it supports my grievance.

In brief, I learned in 2022 that a judgement was entered against me and a lien placed on my home by Navy Federal Credit Union (NFCU) in 2011. I had no knowledge of this until I tried to refinance my home because I was never served and I did not have a debt with NFCU. NFCU received a judgement in 2011 and renewed the lien in 2018 claiming a recovery of a loan back in 2010. The court documents claim I was served a subpoena with regards to this case, but I in fact, was not served. The court documents say the Sherriff served my husband at my home, but I have never been married and I have never lived with any other adult. Further, the original address for me on the loan was not my address and I have never lived there. I totally reject the assertions of NFCU against me, based on the following facts, evidences/documents would also be provided; (a) I was not married in 2010 and I have never been married nor have I ever lived with an adult male. (b) NFCU granted a loan and served the subpoena(s) at an address that was written on the loan documents, where I have never lived at all. (c) I was improperly served and I had no knowledge of this case or the loan. (d) My signature is not on the loan document filed at the court. The loan document does not have a signature at all. (e) The check (loan) was not cashed in my account. (f) Above all, I requested the Attorney for NFCU to dismiss the case based on the grounds of fraud, to my dismay, he denied and is pursuing recovery of the debt. I am requesting NFCU’s attorney dismiss the case by substantiating it as a fraudulent loan and improper service, but the attorney has been persistent and Navy Federal told me they will not release the lien.

NFCU foreclosed on my house very quickly back in 2011/2012. They didn\'t give me much chance to save my house. I have not used my account there since then. They continue to send me life insurance applications and check my credit file. My 80 yr old mother has always banked with them and has all of her assets with them. They told her I could not be a beneficiary on any of her accounts or they would take her money to pay off my house they took and sold. My mom is worried sick because she doesn\'t want to have all her money and assets taken by NFCU when she dies and she wants to leave me her assets (along with my sister). I feel like they are constantly monitoring me and why would they send me any mail at all? Is this a form of harassment? I feel like it is.
