Reliant Capital Solutions LLC Lawsuits

If you want to know just how unhappy consumers are with Reliant Capital Solutions LLC, take a look at the lawsuits filed against the agency on the Public Access to Court Electronic Records (“PACER”). PACER is the U.S.’s federal docket which lists federal complaints filed against a wide range of companies. A search for the agency will display over 80 lawsuits filed across the U.S., most of which involve violations of consumer rights and/or the Fair Debt Collection Practices Act (FDCPA).

Reliant Capital Solutions LLC Complaints

The Fair Debt Collection Practices Act (FDCPA) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA, and this Act is a laundry list of what debt collectors can and cannot do while collecting a debt, as well as things they must do while collecting debt. If Reliant Capital Solutions LLC is harassing you over a debt, you have rights under the FDCPA.

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Reliant Capital Solutions LLC violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Reliant Capital Solutions LLC took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Reliant Capital Solutions LLC, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Reliant Capital Solutions LLC continue to take electronic payments after you told them to stop? Did they take more money from your checking account than you agreed to?  If so, we can discuss your rights and a potential case under the EFTA.

The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Reliant Capital Solutions LLC is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide their citizens with an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above.  North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

How do we Use the Law to Help You?

We will use state and federal laws to immediately stop Reliant Capital Solutions LLC’s debt collection. We will send a cease-and-desist letter to stop the harassment today, and if Reliant violates the FDCPA, EFTA, FCRA, or any state law, you may be entitled to money damages. For example, under the FDCPA, you may receive up to $1,000 in damages plus actual damages. The FDCPA also has a fee-shift provision, which means the debt collector will pay your attorneys’ fees and costs. If you have a TCPA case against the agency, we will handle it based on a contingency fee and you won’t pay us a dime unless you win.

THAT’S NOT ALL…

We have helped hundreds of consumers stop phone calls from Reliant Capital Solutions LLC and we know how to stop the harassment and get you money damages. Once again: you will not pay us a dime for our services. We will help you based on a fee-shift provision and/or contingency fee, and the debt collector will pay your attorneys’ fees and costs.

What if Reliant Capital Solutions LLC is on my Credit Report?

Based on our experience, some debt collectors may credit-report, which means one may mark your credit report with the debt they are trying to collect. In addition to or instead of the debt collector, the original creditor may also be on your credit report in a separate entry, and it’s important to properly identify these entities because you will want both to update your credit report if or when you pay off the debt.

THE GOOD NEWS IS…

If Reliant Capital Solutions LLC is on your credit report, we can help you dispute it. Mistakes on your credit report can be very costly: along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or even being a victim of identity theft. If you have a mistake on your credit report, there is a process to dispute it, and my office will help you obtain your credit report and dispute any inaccurate information.

REMEMBER…

If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (FCRA), you may be entitled to statutory damages up to $1,000, and the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision, which means the credit reporting agency will pay your attorneys’ fees and costs. You won’t owe us a dime for our services. We have helped hundreds of consumers fix inaccurate information on their credit reports, and we’re ready to help you, too.

Complaints against Reliant Capital Solutions LLC

If you’re on this page, chances are you are just like the hundreds of consumers out there being harassed by Reliant Capital Solutions LLC. Here are some of the BBB reviews and complaints against Reliant Capital Solutions LLC:

  1. “Why are debt collectors so belligerent and condescending? Do they realize that makes the business at hand harder? Reliant has a tendency to represent themselves as from the attorney general’s office…they attempt to use scare tactics. Seems to me that they come after people that are paying on their debt or attempting to take care of their debt. They attach fees. They got upset with me because I called to verify who they were and I called to verify a debt they claimed I owed and it turned out that I didn’t owe the amount they claimed. People are not going to be that gullible these days when identity theft is so prevalent and hacking is at an all-time high.”

  2. “Extremely rude and demeaning. I was contacted by them to settle a debt from my school that I was in the process of paying. They said I now owe the original amount and that they wanted me to make a $3,000 payment then and there. I told the woman this was not possible and she told me I had till Monday to come up with the money. She then continued to tell me the monthly payment would be $460 and I told her that was still way too high due to other financial obligations and was basically told by the rep “too bad” and it wasn’t her fault. She then continued to tell me if I couldn’t afford the down payment I needed to pay a total of $500 every two weeks, which I told her is still not possible. Offered no compromise and dodged all of my questions and, as stated above, extremely rude and offered little help.”

  3. “These people harassed me and belittled me. I don’t even have a debt with them but they insist I do. I called the original loan lender to double check and they have no record of my account being sent to collections. I also checked my credit report and have ZERO accounts in collections.”

Based on 46 reviews on Google, Reliant Capital Solutions LLC receives a 1.3-out-of-5 rating. Here are some of the reviews on Google:

  1. The most arrogant company I have ever spoken to. Not only do they harass you but they will harass your family as well. Told them I’m not going to give them a dime until they send me written documentation and they have yet to do that. They call while I’m at work after I have asked them multiple times to not call me between 8am-5pm. [The rep] thinks that he has the right to be disrespectful and cuss at you when he speaks to you. HORRIBLE CUSTOMER SERVICE. I wish there was a way to give them no stars instead of one star.”

  2. Worst experience of my life. Ongoing battle to get the harassing phone calls to come to an end so I can be left alone. They keep calling for Kathleen Reno, some woman I have never heard of before, looking to collect a debt that I do not owe. Seven times I have been called today…in the past five hours talked to a representative each time. By law they are harassing me at this point and my lawyer has been contacted in regards to filing further charges against the company. It’s time to take a stand…these tactics aren’t allowed and are punishable by law. I recommend if you get a call from this company in regards to a debt you don’t owe, call your lawyer.”

  3. When I received the phone call the person was extremely rude and hung up on me when I explained I couldn’t afford to make payments currently due to not working. They called multiple times a day being rude. Once I agreed to pay them and paid them a large lump sum, they continued to take money out of my bank account without my permission. When I called to ask them about it, the man on the phone got rude and called me ignorant and a ton of other names. The payments were getting posted to my account and the amount owed was dropping until last month. They took out more money than they were supposed to and it never posted on my account. When I called the guy, he told me I was overdramatic…”

Cases We’ve Handled Against Reliant Capital Solutions

I think you’ll agree when we say that threats and harassment from collection agencies can be pretty intimidating. However, we can stop the harassment and get you money damages under the law, and the collection agency will pay your attorneys’ fees and costs. Here are two cases we’ve handled against Reliant Capital Solutions:

  1. Lila I. v. Reliant Capital Solutions – In January 2016, Lila of Suffolk County, New York, filed a claim against Reliant Capital Solutions for violations of the Fair Debt Collection Practices Act (FDCPA). Complaints consisted of harassing phone calls, including after repeated requests from the plaintiff that the calls stop, and “harassing, oppressive, and abusive” conduct in connection to an alleged debt.

  2. Grant W. v. Reliant Capital Solutions – In October 2014, Grant of Aiken County, South Carolina, filed a claim against Reliant Capital Solutions for violations of the Fair Debt Collection Practices Act (FDCPA), Electronic Fund Transfer Act (ETFA), and South Carolina Consumer Protection Code. Complaints included harassing phone calls, “oppressive and abusive” conduct in connection to an alleged debt, threatening to take actions that could not legally be taken, and charging service fees without the plaintiff’s knowledge or authorization.

Can Reliant Capital Solutions LLC Sue Me?

Although anyone can sue anyone for any reason, we have not seen Reliant Capital Solutions LLC sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. If Reliant Capital Solutions LLC has threatened to sue you, contact Mike Agruss Law as soon as possible.

Can Reliant Capital Solutions LLC Garnish my Wages?

No, unless they have a judgment. If Reliant Capital Solutions LLC has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above. If Reliant Capital Solutions LLC has threatened to garnish your wages, contact our office right away.

Reliant Capital Solutions LLC Settlement

If you want to settle a debt with Reliant Capital Solutions LLC, ask yourself these questions first:

  1. Do I really owe this debt?
  2. Is this debt within the statute of limitations?
  3. Is this debt on my credit report?
  4. If I pay this debt, will Reliant Capital Solutions LLC remove it from my credit report?
  5. If I pay this debt, will the original creditor remove it from my credit report?
  6. If I pay this debt, will I receive confirmation in writing from Reliant Capital Solutions LLC for the payment and settlement terms?

These are not the only things to consider when dealing with debt collectors. We are here to help you answer the questions above, and much more. Whether it’s harassment, settlement, pay-for-delete, or any other legal issue with Reliant Capital Solutions LLC, we at Mike Agruss Law are here to help you.

Top Debt Collection Violations

Debt collection laws provide a laundry list of what collectors can and cannot do while collecting a debt. Based on our years of experience handling thousands of debt collection harassment cases, here’s what collection agencies most often do to violate the law:

  1. Called you about a debt you do not owe.
  2. Called you at work after you told them you cannot receive calls at work.
  3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third-parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third-party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said to stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

Frequently Asked Questions

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery. Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  2. What are the damages I can get under the Fair Debt Collection Practices Act? If a collection agency violates any section of the FDCPA, you are entitled to damages up to $1,000.00. You may also be entitled to actual damages if the violation caused you out-of-pocket expenses. For example, if a collection agency threatens you with legal action to induce you to pay the debt, you may be able to get your payment back as actual damages.

  3. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, Defendants often pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  4. What type of debt is covered under the Fair Debt Collection Practices Act? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. The FDCPA does not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. Original creditors, such as banks and credit card companies, are not bound by the FDCPA.

  6. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens with an additional layer of protection. If you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, or Wisconsin, you have additional state-law rights.

  7. Are mistakes on credit reports common? Yes! Are you one of the 40 million Americans who have a mistake on their credit report? Mistakes on your credit report can be very costly.  Along with causing you to pay higher interest rates, you may be denied credit, insurance, a rental home, a loan, or even a job because of these mistakes. Some mistakes may include someone else’s information on your credit report, inaccurate public records, stale collection accounts, or maybe you were a victim of identity theft.

  8. What do I do if I have a mistake on my credit report? If you have a mistake on your credit report, there is a process to dispute them. My office will help you pull your credit report and dispute any inaccurate information. If a credit reporting agency violates its obligations under the Fair Credit Reporting Act (FCRA), you may be entitled to statutory damages up to $1,000.00, plus the credit reporting agency will be required to fix the error. The FCRA also has a fee-shift provision, which means the credit reporting agency pays your attorney’s fees and costs. Therefore, you will not pay me a penny for my time. To speed up the process, please get a free copy of your credit report at www.annualcreditreport.com. You can also learn more about the FCRA and your rights at http://www.agrussconsumerlaw.com/practices/common-credit-report-errors/.

Hi Cassie, If you want Reliant Capital Solutions to stop calling you at work all you have to do is tell them to stop calling you at work. Once a collection agency knows you cannot receive calls at work, they must stop. If you tell Reliant Capital Solutions to stop calling you at work, and they call you again, then Reliant Capital Solutions has violated the Fair Debt Collection Practices Act ("FDCPA"). Under the FDCPA, consumers may receive up to $1000 in money damages, and the collection agency has to pay for your attorney's fees and costs, too. I will contact you so we can further discuss your rights. At the very least, I will get Reliant Capital Solutions to stop calling you at work. Thanks, Mike.

They called my aunt, who has never done anything financial with me, literally, aside from the occasional 20 bucks in a Christmas card. She has nothing to do with any debt I owe to anyone. I am also not at the point of having to pay back my student loans because I am still in school. Can I get them to not call anyone other than me? And even still, can I get them to not call me, as I see them as a scam? Thanks, Kira

i have been receiving calls non stop from reliant capital solutions about a school loan debt. i agreed to begin making payments but when i ask for information that i am requested to send which is my 1040 and other information which they require. i was supposed to receive an email from them so i can begin payment but i have received nothing as of yet. they threaten me with wage garnishments, jail and ruining my credit. i just want the harassment to stop. the threatening phone calls must stop as well. i already agreed to pay them but with little to no information provided by them makes it impossible.

It began in 2014. Phone calls saying they were collecting on an Ohio lien for u filed taxes for 4 random years. 2001, 2004, 05, 06. But I had filed, and had filings and w2s to show. I actually got refunds for 3 of those 4 years. I had to hire legal teams to deal with Reliant, and they kept offsetting my Ohio refunds. We worked with Reliant to re-file, and they suddenly lost my file and began process all over again. So, we filed once again and settled with the state. Last August. But, since Reliant lost my returns, we chose to work directly with the state the seconds time. Paid all taxes,,and had liens released in August. State was satisfied and documented. All was cleared from credit report, which was my goal. But because we worked with the state, Reliant apparently never got paid? Not my problem. Never heard a word from them again. Suddenly, we filed joint this year for the first time. We were to receive a $2140 return, and it was offset $498. When I called to inquire, the federal representative told me Reliant had collected the refund amount, and gave me a file number to reference, and a number to call with Reliant. When I called Reliant, the same individual who lost all of my paperwork, and fabricated numbers "chuckled" and said I still owed penalties and interest and his fees? How in the world can he abuse his collection privileges and garnish my FEDERAL text refund, and my wife's as we were combined? This was a state issue, they were hired by the state, and to be paid by OHIO, not by my wife's tax return. How did the Federal IRS, comply with his request to offset a FEDERAL return. And why is the file reference number only one of the four years in question? How do we protect ourselves from this company arbitrarily garnishing our money? He wasn't even hired by the federal government. How did he submit this?

I wanted to get some legal consultation concerning debt collection. I went to study at a grad school that prmoised assistantship. But i wanted to quit in the middle. Now, they are trying to collect the alleged debt. They call me at my relatives home, my office, etc even after i informed them not to call. I have actually been making some small payments. I was wondering if there is a nice way to legally deal with this. the call from the company has just been no less than an outright harassment. they call me many times many days!

I am trying to get some help in dealing with a company called Reliant Capital Solutions.Yes, I was a student at Liberty University back in 2011 and during one session withdrew from a class. The class was paid for by federal student loan. After withdrawing from the class, the remaining funds from the University that was paid by the Federal Student Loan program was returned to me in the form of a check. Of course I paid that money towards my outstanding student loan balance. Then Liberty University billed me for the class over a month later...... I explained that I had already paid the money back to my student loan account but they stated that I owed them the money. Now reliant capital solutions has been calling me nonstop about recovering the money owed to the school even though I explained that the money had already been paid back to the federal government. I even went so far as to agree to set up a payment plan with them, even though I still think this is wrong, but after I set of the payment plan with them of $100 a month, they added a service charge of $4.95 to the amount, so I cancelled the debit card that the money was coming off of so that they could no longer charge me. And just earlier today I received a call from them and the representative stated he did not want to argue with me "which I was not arguing" and threatend just to forward my information to their legal department!

here to make a complaint about Reliant Capital solutions, so I received a phone call by them asking about who I was. When they realized they did not have the "right" person, I asked why they were calling which they would not disclose (ie debt collection etc) the reason I had asked is I had received phone calls before about this person in regards to debt collection. They used my work government phone number which they would have only gained if they had looked at a govt listing. the last time this occured I had informed them several times that I was not the right person. Then they had sent a request to human resources with a request to "garnish wages" on a debt that wasn't mine. I found out who the company was and then sent letter to cease and desist. this was a few years ago. when the call came yesterday, the message seemed similar, not clearing identifying why they were calling etc. when I spoke to the person today, he became angry and stated that my phone number listed with this other person (who has the same name) was due to a "system problem' rather than the company. so, I am not sure how to get the "system" corrected or if it is even the "system" that obtains government employee phone numbers to anybody that wants it, cant' really think of any thing although I have an excellent credit rating and get quite angry when these calls are generated!

My neighbor said he received a call about some legal documents and forwarded the reference number and phone number to me. I called and the person that answered simply said hello. I asked him to identify the company and he would not until I gave the reference number. I told him they were the ones that called my neighbor, he could figure it out. I was transferred to someone else and after asking a few times he said it was RCG & Assoc. I asked what they did (since I was still not aware) and he said they work with legal firms regarding lawsuits and civil litigations. So I asked who exactly could be suing me. He told me and I asked why had I not received letters and he told me the address they were supposedly sent to. I told him I hadn't lived there in five years, and if they can call my NEIGHBOR then they clearly know where I live! He said that was not his problem, it was my fault I didn't update my address with my debtors. He also quoted the debt $200-300 more than what is on my credit and I pointed that out, he said "I guess they are trying to collect interest." I told him I wanted to resolve this and would after he sent me the notice I never received, he said it was too late for courtesy notices and the collectors would be moving forward with their litigation. I said so I'm going to be arrested for a stupid debt that's less than $1000 and he said he couldn't stop that at this point unless I made a payment over the phone with him now. I also tried multiple times to give them my correct address and he simply refused to take it. He said he had just pulled my credit (and I promise my current address is on it!) I told him I wanted to go home and look them up and double check my credit report myself, at that point he said if I didn't want to pay my debts and I was willing to take a chance (implying I'd be arrested) that wasn't his problem. I came home and pulled my credit and ironically that debt is due to come off my credit in 4 days. My old address also happens to be a relative and they would have given me my mail. I don't know if they broke any rules, but they are at best terribly unethical. As a survivor of domestic abuse and stalking, they didn't take a very nice approach.

I owe online federal student loans after attending Ashford University. I was sent a packet to fill out or 15% of my income would be garnished. I only have until Friday to respond, but I believe I was scammed out of my repayment that I started about 4 years ago and had to discontinue payments. I owe over $50,000. I am still a clerk at a Public Service Agency and thought I would get full student loans forgiveness. I am constantly being called about this debt. If I had the money and a better job, I would pay. I am worried that we will be homeless if they attach my wages with a garnishment. What can I do to get rid of this debt? My degree is not helping my income, even though I have applied for numerous other jobs. Can you please assist me!

Well I recently got told I have offset debt due to student loans so I have worked out arrangements through reliant capital solutions who say I have to make 10 consecutive payments on time before I can get my taxes!

Reliant in Gahanna sent me a notice threatening garnishment on USDOE letterhead; I told them I was going to request a hearing, manager said we will garnish anyway because it takes too long to get a hearing. I sent request certified along with copies of correspondence to DOE ombudsmen's office from more than 10 years ago disputing the debt for breach of contract. Received a notice back denying in person hearing; said I will be subject to garnishment unless I contact Reliant in 15 days. Letter was unsigned, it just said Hearing Officer, Borrower Services. This AWG office in Texas appears to be a front for Reliant and not a legitimate USDOE office. What can I do? Thx!
