Who is Spectrum Billing Services?

Spectrum Billing Services is a third-party debt collection agency based in Los Angeles, California. Founded in 2002, this agency is not accredited by the Better Business Bureau (BBB) and minimal information about it is available, though it has received numerous complaints via the BBB (which have since been hidden) for billing/collection problems and unlawful harassment of consumers.

Spectrum Billing Services Complaints

The Fair Debt Collection Practices Act (FDCPA) is a federal law that applies to everyone in the United States. In other words, everyone is protected under the FDCPA, and this Act is a laundry list of what debt collectors can and cannot do while collecting a debt, as well as things they must do while collecting debt. If Spectrum Billing Services is harassing you over a debt, you have rights under the FDCPA.

The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. You can receive $500 per call if Spectrum Billing Services violates the TCPA. Have you received a message from this agency that sounds pre-recorded or cut-off at the beginning or end? These are tell-tale signs that the message is pre-recorded, and if you have these messages on your cell phone, you may have a TCPA case against the agency.

The Electronic Fund Transfer Act (EFTA) protects electronic payments that are deducted from bank accounts. If Spectrum Billing Services took unauthorized deductions from your bank account, you may have an EFTA claim against the agency. Spectrum Billing Services, like most collection agencies, wants to set up recurring payments from consumers; imagine how much money it can earn if hundreds, even thousands, of consumers electronically pay them $50 – $100 or more per month. If you agreed to this type of reoccurring payment, the agency must follow certain steps to comply with the EFTA. Did Spectrum Billing Services continue to take electronic payments after you told them to stop? The Fair Credit Reporting Act (FCRA) works to ensure that no information reported to your credit report is false. In essence, it gives you the right to dispute those inaccuracies that you find on your credit report. We’ve handled many cases in which a debt collection agency reported debt on a consumer’s credit report to obtain leverage over the consumer. If Spectrum Billing Services is on your credit report, they may tell you that they’ll remove the debt from your credit report if you pay it; this is commonly known as “pay for delete.” If the original creditor is on your report rather than the debt collector, and you pay off the debt, both entities should accurately report this on your credit report.

Several states also have laws to provide their citizens an additional layer of protection. For example, if you live in California, Florida, Michigan, Montana, North Carolina, Pennsylvania, Texas, or Wisconsin, you may be able to add a state-law claim to your federal law claim above. North Carolina, for example, has one of the most consumer-friendly statutes in the country: if you live in NC and are harassed over a debt, you may receive $500 – $4,000 in damages per violation. We work with a local counsel in NC and our NC clients have received some great results in debt collection harassment cases. If you live in North Carolina and are being harassed by a debt collector, you have the leverage to obtain a great settlement.

We will use state and federal laws to immediately stop Spectrum Billing Services’ debt collection. Can Spectrum Billing Services Sue Me?

Although anyone can sue anyone for any reason, we have not seen Spectrum Billing Services sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. Can Spectrum Billing Services Garnish my Wages?

No, unless they have a judgment. If Spectrum Billing Services has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above.   6. Disclosed to a third-party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said to stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee. That means either the other side pays your fees and costs, or we take a percentage of your recovery. Whether it’s a fee-shift case or a contingency-fee case, we don’t get paid unless you get paid, and you’ll never owe us a penny for our time.

  2. What are the damages I can get under the Fair Debt Collection Practices Act? If a collection agency violates any section of the FDCPA, you are entitled to damages up to $1,000.00. You may also be entitled to actual damages if the violation caused you out-of-pocket expenses. For example, if a collection agency threatens you with legal action to induce you to pay the debt, you may be able to get your payment back as actual damages.

  3. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, Defendants often pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  4. What type of debt is covered under the Fair Debt Collection Practices Act? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. The FDCPA does not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No.  Only third-party debt collectors are bound by the FDCPA. Original creditors, such as banks and credit card companies, are not bound by the FDCPA.

  6. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. If you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, or Wisconsin, you have additional state-law rights.

Repeatedly charged me for services I asked to not only be removed on multiple occasions but services I clearly and concisely said I didn't want in the first place. After months of this they owe me yet my balance grew. The last time I called I was told that in order to take off the fraudulent charges that I would have to pay the complete bill. A tactic ATT used to get my money and then overcharge me again. I explained that I am not falling for that trick again. The executive I was speaking with became irritated at my refusal to pay my 120$ bill when they owed ME around $200. She then used that opportunity to bill me again and added even more charges even though I no longer even had service tripling the "owed" amount and then angrily telling me that I can now end my dealings with the company. Billed early and more than the already egregiously fraud filled invoices of before. They are lying and stealing and it's their business model. Our regulatory bodies have been long since captured. I'm hoping you are as sick of this blatant theft as most Americans are. I don't care about being compensated. I want you to make them pay. Perhaps change the industry.

Spectrum has been calling me, my wife and my father in-law, trying to collect $4000 from 2003 and 2004. I spoke with a female representative and she threatened to release tapes of phone calls to my wife and father in-law. She also threatened with me a lawyer and to tell my employer as well garish my wages.

I am a 16 year old kid, this company keeps calling my number demanding me to pay for some adult entertainment service, and I repeatedly told them that I am a minor and then a lady showed me a recording of a man speaking and kept on telling me that it was me, please help me, I am tired I already blocked them from my phone, I don’t know what to do!

I really need help with these Spectrum Billing Services people. They’ve definitely sent at least 15 or maybe more paper’s in the mail in my father’s name. I’m 15 years old and was 14 when I made this calls and used a debit card with no money on it, I didn’t know any better because this has never happened to me. My dad kept seeing the bill rise eventually it became nearly $500. I paid it with my dad’s credit card without permission and I got in even more trouble for it because I already kept getting in trouble for all those incoming letter’s. After a month he saw the name in the statement and told me he disputed it and now they keep calling his phone, my phone, and even my brother’s phone. I have no idea how they found my brother’s phone because he has no relevance to this situation. Now they keep calling but I blocked their number on my phone and my dad’s phone. I already know they’re going to send more letters. I’m scared and know these are a scamming non legitimate company. They yelled at me over the phone demanding me to pay. I have yet to mention I am a minor but I know saying anything won’t matter to them because all they do is harass and demand money. They say you get a free 10 minutes and then enter a card number. They 100% never mentioned any pricing or anything and my dad saw all the declined transactions on that empty card I used and it was like 40 attempts trying to charge me in amounts of $0.50 up to $150 and they all did decline. These are some big time scammers that need to be stopped and need to stop bothering my family.

Hi Samir. Debt collectors will be relentless when they want to collect, including calling your friends and family and threatening consumers with legal actions. Under the law, children cannot be held liable for debts, however it can affect them throughout their adulthood, including job prospects and loans. Hi Mike. Are the charges with Spectrum Billing Services legitimate? I have heard multiple cases where they use recordings to scare people into paying for calls that were not legitimate. Representatives from debt collection agencies and lenders are not permitted to threaten anyone, if they do so, they are violating your rights. I received a call from a person named Candace with Spectrum on 9/28/2022 and she said i owed them money for a debt. I explained to her i would pay this debt and asked if i could make payment arrangements with her starting first payment in the first week of October ! She said that she had to gave a vredit card number or checking account number right now for at least a 1/2 payment of the debt and the 2nd have in 30 days ! i asked he to make this payment on Monday O

Hi, about 2 months ago, I noticed a charge I did not recognize on my credit card which I disputed, now I keep on receiving letters from spectrum billing services addressed to different people at my address (I don\'t know how they got their info). 1- Did they brake the law when obtaining information illegally? 2- Did they brake the law when addressing letters to several people when this means that they are notifying other people of someone\'s alleged debt. 3- Do I have to tell them my name when asking them to cease contacting me (That\'s what they claimed). Please note that I\'m out of the country right now that\'s why I did not include my phone number.
