The Fair Debt Collection Practices Act (FDCPA) is a federal law that applies to everyone in the United States. The Telephone Consumer Protection Act (TCPA) protects you from robocalls, which are those annoying, automated, recorded calls that computers make all day long. You can tell it’s a robocall because either no one responds on the other end of the line, or there is a delay when you pick up the phone before a live person responds. Can Transworld Systems, Inc. Sue Me?

Although anyone can sue anyone for any reason, we have not seen Transworld Systems, Inc. sue consumers, and it’s likely that the agency does not sue because they don’t always own the debt they are attempting to collect, and would also need to hire a lawyer, or use in-house counsel, to file a lawsuit. It’s also likely that the agency collects debt throughout the country, and it would be quite difficult to have lawyers, or a law firm, licensed in every state. However, there are collection agencies that do sue consumers; for example, Midland Credit Management is one of the largest junk-debt buyers, and it also collects and sues on debt. Still, it is less likely for a debt collector to sue you than for an original creditor to hire a lawyer or collection firm to sue you. Can Transworld Systems, Inc. Garnish my Wages?

No, unless they have a judgment. If Transworld Systems, Inc. has not sued you, then the agency cannot get a judgment. Barring limited situations (usually involving debts owed to the government for student loans, taxes, etc.), a company must have a judgment in order to garnish someone’s wages. In short, we have not seen this agency file a lawsuit against a consumer, so the agency cannot garnish your wages, minus the exceptions listed above.   3. Left you a message without identifying the company’s name.
  4. Left you a message without disclosing that the call is from a debt collector.
  5. Called third-parties (family, friends, coworkers, or neighbors) even though the collection agency knows your contact information.
  6. Disclosed to a third-party (family, friends, coworkers, or neighbors) that you owe a debt.
  7. Contacted you after you said to stop calling.
  8. Threatened you with legal action (such as a lawsuit or wage garnishment).
  9. Called you before 8:00 AM or after 9:00 PM.
  10. Continued to call you after you have told the collector you cannot pay the debt.
  11. Communicated (phone or letter) with you after you filed for bankruptcy.
  12. Failed to mark the debt on your credit report as disputed after you disputed the debt.

  1. Do I have to pay your fees and costs for helping me with my consumer rights case? No. We handle consumer rights cases based on a fee-shift provision and/or a contingency fee.   2. What are the damages I can get under the Fair Debt Collection Practices Act? If a collection agency violates any section of the FDCPA, you are entitled to damages up to $1,000.00. You may also be entitled to actual damages if the violation caused you out-of-pocket expenses. For example, if a collection agency threatens you with legal action to induce you to pay the debt, you may be able to get your payment back as actual damages.

  3. What are the damages under the Telephone Consumer Protection Act? You can get $500 per robocall, or $1,500 per robocall if the robocalls were willful. In any type of settlement, Defendants often pay much less than $500 per call. However, if there are 50 calls at issue, even at $250 per call, your case could settle for $12,500.00.

  4. What type of debt is covered under the Fair Debt Collection Practices Act? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. The FDCPA does not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. Original creditors, such as banks and credit card companies, are not bound by the FDCPA.

  6. Are there state laws that protect me from original creditors? Yes! Several states also have laws that provide their citizens an additional layer of protection. If you live in California, Connecticut, Florida, Kansas, Massachusetts, Michigan, Missouri, Montana, North Carolina, Nevada, Oklahoma, Pennsylvania, Texas, or Wisconsin, you have additional state-law rights.

Transworld calls me everyday I know I have debts but dont trust any of these calls because I get calls from so many different numbers they never mail me anything and want me to give info over phone when I say no they get rude.. I block numbers then they call from another number

They started calling my phone 4 weeks ago, They are not even asking for me. I continue to tell them they have the wrong number and they continue to call. I work 3rd shift and they will start calling at 8:30 am every morning and call up to 11 times a day. It's driving me insane. I'm getting harassed constantly and I don't even owe them anything.

I have no debts, I haven't answered any of their calls. My business phone answering machine was filled up with their calls and I have lost customers because of it. Transworld has been calling my employer and faxing them asking for my home information. When they send a fax to out general office machine they put my full social security number for anyone in the office to see. I don't know who they are but any debts I owe already have my mailing info attached to them.

Transworld Systems has been calling me daily since the 1st of August, 2017. It's always an automated recording telling me how important it is that I call them even though I have no idea what it is they want. I have blocked them on my phone but am unable to block them from leaving voicemail. I really need this to stop!

I wish they were only calling and harassing meet when they start red flagging and blacklisting you for speaking out the truth and not taking their you know what that's pretty bad next is erasing me and I'm a good person all I've done is spoke out the truth and stood up for what was right when they stole my house and and ripped me off from child support money and I proved it in the bank had to pay it back they didn't like being found out about and still I've lost my home and now they're ruining my credit they're trying to destroy me and kill me so my blood is on their hands and don't think for a minute they don't do it cuz I'm living proof I just lost a very good job with ups for no reason and I know why because somebody red flag me somebody higher up told them get rid of her

I think we need to get rid of these three companies entirely and have an honest way of passing judgement on somebody's credibility and credit because people's lives are being destroyed because of this wrong action because of these lies because of these mishaps you know what they're holding people's lives in their hands it's time to stop this kind of crime. let's not act like we don't know what's going on it's time to start standing up for the good people and stop listening to the bad

Does Transworld Systems only call you once a day at 11:00 am? My experience with my clients is they calling several times a day. I have been getting calls from transworld systems everyday multiple times a day for the past two weeks. When I answer the phone, there is no reply. Ive even sat on the phone for over 1 minute to see if someone was going to say something. i tried calling the number back many times and it always goes to a message that says, "im sorry, the number you are trying to reach is no longer in service." until about 3:30am this morning i finally got an answering machine saying that it was Transworld Systems. i work night shifts and their phone calls wake me up every single day some times more than once a day!

They called today, for the first time- it will be the last for this number, (312)579-3407, that you do not list. I called them back and got a machine saying "thank you for calling Transworld"... blah blah. I have no idea why they called me except that I often get calls from people looking for persons who never had this number (it has been mine for six years). This particular number is now blocked on my phone.

Aug 21, 2018 Please see attachment I’m seeking help from our communities’ higher California office men and women to help demolish this account. In 2005 I open an Army & Air Force Exchange military Starz card, my balance due was $6000.00, in 2008, I lost my job and I tried to compromise with the Army & Air Force Exchange by offering $3000.00 to closed my account, they basically said No. Thirteen years later, I received a statement in the mail from Transworld Systems Inc stating I owed the following, May 2018 ($16603.07), June 2018 (16,700.79), July 20,18 ($16899.49) and in Aug 2018($21,1391.76) On the 08/08/2018, I received a letter from Social Security Benefit stating Army & Air Force Exchange will withhold up to 15 percent of my monthly Social Security benefit payment. I called the Army & Air Force exchange credit department, spoke with the supervisor, she said they no longer have the debt, they have forward it to Transworld Systems in Aug 2008. bye, the way, the ten years statue for this account will expire this month. I called Transworld Systems, spoke with the person who is assigned to the account, he said we can do whatever we want with this account, “he said if you call me again today, for example, is Aug 1, 2018, your balance is ($16899.49) on Aug 20, 2018 on Aug 20, 2018, your balance will be 21,139.76”. Transworld Systems Inc collection agency, is unjust and bully. The debt was concealed for 12 years old, I tried to compromise with these companies, but they believed it was okay to conceal a large debt for many years then collect on. Transworld Systems Inc, stated I will offer you a settlement in the amount of $9400.00 and I had 30 days to pay it. If I don’t pay it, I’ll never receive another offer. What a bully, 30 days to pay $9400.00 dollars. I had to withdraw my Social Security Benefit due to this action, Your prompt attention is appreciated!

They were calling me everyday and I never answered. They would tell me they were a debt collection agency and for me to contact them There were some days I would even get 2 calls from them. They would sometimes charge their number where it would look like someone else was calling. They would even call on Saturday. Usually guaranty they would make first call around 830 am and then usually around 500pm sometime even would call as late as 8pm.

I've recently contacted TSI about a 98.00 debt that is showing up on my husband's credit report. I called because I wanted to find out what it is for, and pay the debt if it is something that we owe. When I go to Lifelock it only gives me the last two digits of the account number. So when I contacted them to find what the debt was, I was transferred to a rude man, and he asked for our Address and phone number, I gave it to him because I knew they have been calling. However, I've received nothing in the mail. So when I asked him if he could just tell me what it was, so we could determine if it's fraudulent, he raised his voice and said, " Is there anything else i can help you with", and I said " Yes, if we owe the debt, we want to pay but please just let us know what it is for. He again raised his voice asking, "Is there anything I can help you with, I politely said, " Nope. Have a great day!" I called one credit Bureau, Transunion and she said it wasn't showing up as a debt, YET. Now all three, Transunion, Experian and Equifax are showing it's as an open, unpaid collection. I have no way of knowing if it's fraudulent activity or if it's something we owe because this despicable, shameful buisness will not give us any information. Nor can I pay the debt becasue when I tried to pay the debt all I wanted to know, was what was it for, and as soon as I started asking questions the half-man shut me down. Then I made sure to tell him to send me a bill and gave him my address, still nothing. So, I'm suspicious that it may be a fraudulent act. We are trying to buy a house then this pops up. They have called our cell, as late as 8-9 pm, yet they refuse to send a bill. So what I'm left to do is file a claim with all three credit bureaus, informing them that it's not our debt becasue TSI refuses to work with us. Collection agencies are given way too much leeway and if this turns out to be fraudulent activity we are hiring a lawyer BECAUSE we tried contacting them, and they were not forthright with the information we need. And they call and harass me ALL day long, yet will not work with us. I'm a Christian and don't believe in suing people but this can't be legal or ethical business practice, and I have no problem investing the time or the money due to this one infraction on our credit report, which has significantly lowered my husband's score. I have a friend who owns a credit agency, it's a family business, and they don't work like this. Backing people in a corner, harassing people, then not being willing to help when we call to settle a debt is just plain creepy. Anyone interested, who has proof of harassment and their unwillingness to work with you on fixing your debt, contact me at [email protected] with your problems and I will pass it along if my husband and I do decide to file suit. There's just something not right, and we have rights, all of us, to protect our credit and have a fair opportunity to fix our debt. And when they call you, answer and talk to them, tell them they are being recorded(you can download an app for your phone that records calls)and you are willing to pay the debt if they will provide you with information of the debt. And when they refuse to cooperate, record and continue to contact them. We have a right to know what our debt is, and I haven't received a notice since calling them and giving them our home address, so it's shady business at the least, at it's worst it could be illegal. A couple years ago we fixed our credit and all three agencies provided us with the information we asked for--they were old doctors bills, we were not aware were on his credit until we signed up with Lifelock. We paid the debts, and two companies still haven't closed the accounts but it does say paid. The woman at Transunion said they will stay on our account for time it takes to be automatically removed, which I think was three years. But the 3 credit agencies I worked with provided me with the information on the debt because they were small amounts and we couldn't even figure what they were for. If your being harassed after you paid, that's illegal. And if your trying to settle a debt and they will not provide you with the information needed but only want to harass you, then what else are you left to do then hire an attorney. And BTW the more people who come together with LEGITIMATE claims, whether complaining to the BBB or reporting it to the three credit bureaus, and being informed about your rights and the right to dispute a debt--especially if they refuse to work with you--is the only way to take action. consult a lawyer and if you don't have the money, there are plenty law firms waiting to represent you BECAUSE collection agencies have gone mad and are not obeying the laws or federal regulations and guidelines. FACTA is one, do your research and don't let these people ruin your credit or your life. but you have to record the calls and dates and make an attempt to settle the debt, if they refuse to give you information on your debt then they are violating your rights! This is the review I've been leaving as a complaint. It sums up my experience. We are being harassed and they have refused to give us information on the debt, so we don't even know if it is fraudulent activity. Mine and my husband's phone ring all day long and I know it's them because it is the only debt showing up on our report. They have not notified us by mail, we found out about the debt using Lifelock account. BBB is worthless, they will not let me leave my email for all the other victims, to contact me about similar complaints. This $98 debt has ruined my husband's credit, while we are trying to buy a house at the moment. When I contacted Transunion she said there was no debt and now the debt is showing up on all 3 credit bureaus.

I am a lawyer in private practice. My wife and I did have an ADT account, which we closed and obtained a different system by Infinity. long after, we got a dunning notice and calls from Transworld. I sent them copies of our documents to show that we were paid up with ADT when we cancelled. I called the company and spoke with a manager and after that, which was more than a year ago as I recall, they left us alone. Now we got another notice. I would like any good advice you can give me. The bill is $129.94!

Its for a debt to the Army & Air Force Exchange Service, they have taken my tax return since 2011, which has more then paid the original debt, but they claim it only pays the interest!

I'm having an issue with Transworld. I called to set up a repayment plan and they said the only thing they would accept is $4000 down adn $200 biweekly. It is a $15000 debt that I incurred when I was in the military and I have been out since the beginning of 2009. Every year they take my federal tax return and apply it to the debt which keeps growing. They just sent me a wage garnishment letter. It appears that the terms I was offering would pay better than the garnishment but still less than what they demanded!

Can you look up ID#30606192 & tell me who you are looking for? I’ve been receiving a lot of voicemails. I have a few medical collections, however I’m on SSDI due to my blood cancer diagnosis. So I have about 40k in medical expenses from my bone marrow transplant. I am still recovering & I don’t go back to the transplant hospital til October. I am the only one currently receiving $ as my hubby was fired from his employer during his “approved” unpaid time off. I have a ton of medical bills, lodging, airfare, donor expenses, etc. showing the insane amount of $ we have spent to save my life. I will be more than happy to forward any records for your files. That I’m on SSDI & there’s no way for collectors to garnish my benefits. I would rather avoid medical bankruptcy. Plus I don’t think that’s necessary since no one can collect from me. I am not stressing myself out during my recovery. They can communicate via email as I have a lot of doc appts, labs, etc. I have problems sleeping so it’s hard to reach me via telephone!

I receive these calls everyday from Transworld System. Usually a call with no message. Today they left a message = cut off at the beginning as your website described. These calls are probably related to my daughter who no longer lives with me. In addition, she is working with a Debt Consolidator since last year, so to still receive these calls gets annoying. It's been going on for at least the last 9 months, everyday at least 2 or more times, with different numbers - I guess as your website describes - robocalls!

They had no current info on our account like our address but it's all current on out debt account we owe. And they never leave a voicemail. I've been having issues with Transworld and would like some assistance. My federal income taxes have been offset from 2012-present. Last year I finally figured out where they were going. I contacted army and Air Force exchange, they referred me to transworld. When I contacted transworld, they gave me conflicting balances. I sent 2 dispute letters and they closed the account without validation and sent it back to army and Air Force exchange services where they wouldn't allow me to settle and attempted to enroll me into monthly payments. Because I refuses to comply, they have now sent the debt back to transworld where they are already scheduled to offset my federal taxes on the 14th of this month and they've yet to validate the debt. From my understanding a debt collector can not collect on a debt when unable to validate I owe them per my consumer rights!

I just want to know how to get Transworld Systems to stop calling. I have a very common name. They say they are calling about an ER Physician group in Texas. They won't listen or anything until I give them my date of birth. I do not give out personal information just because someone asks for it. How can I make them stop? I think I have just confirmed information. I've been getting calls from Transworld regarding a debt I legitimately owe but when I talked to the creditor a few weeks ago, their response was pay it when you can. Transworld keeps asking me to confirm my address by giving it to them. I have told them that if they tell me what address they have, I will either confirm or tell them it's wrong. They either won't or can't tell me my address. I asked for them to mail me documentation that they are legitimately collecting for this company and it comes back to confirming my address. I have been through this before so I'm pretty familiar with what they can and can't do. I'm technically working and had just received a call from an unknown number so I googled it and came up with lots of information about them. I will not be dealing with them at all but rather with my original creditor!

Transworld systems call me weekly. Saying I owe a debt to a creditor I am currently paying on 4 loans. They said yeah this one was sent to us. I asked for original paperwork and it took them 2 months but they kept calling me. Always a different number. They finally emailed me documents. They posted 5 times on my credit report if it has been completely removed every time. Do I set up payment with them or try to contact the original loan company? I thought this loan was paid since it was removed from my credit report several times. They call from autodial and every week before 8 am and after 5. They called at 630 today!

Transworld has been calling me on my cell phone for a dentist debt for my wife that was paid for by a non-profit organization. They started in December and stopped in April (for now anyway) I keep call records and screenshots. Non of their phone numbers show up on my Sprint phone records and some of the phone number they use are spoofed. Donated dental paid my wife's bill and then the dentist retired. Transword Systems is currently garnishing my wages for a Military Star Card debt that goes back to 2010. At the time the debt went into default, I was struck with colon cancer and went through several years of recovery, including chemo. The form they sent my employer is the SF-329B, which is taking the wages out as student loan debt, which is incorrect.

You may ask the original creditor to take the debt back, and if they agree to, make sure that you get, in writing, proof that they again own the debt and that they've agreed to your repayment terms. Hi Douglas. Debt collectors can call before 9am. Under the law they can call between 8am-9pm your local time. It is also not illegal for them to contact you over a debt your loved ones owe. Hi Brian. Typically debt collectors are not permitted to garnish disability checks, except under certain circumstances, including student loans. Have you contacted law enforcement regarding the forgery done by your former wife? I would recommend that you do so immediately. Hello, I received a letter that they were going to garnish my wages in Nov. so I called them and set up a payment. I just received a message from the IRS stating they were taking part of my refund on my taxes. I made an agreement with the TSI stating they wouldn’t garnish anything if I made the monthly payment and was current. Which I am. I don’t know how to handle it. Thanks

I had a charged off military star card back in 2012. I disputed charges and never heard back. Last year I never received my first stimulus payment. This year I claimed the recovery rebate. My stimulus from the recovery rebate was taken due to this old credit debt. I called Transworld and they told me that evidently the debt was valid even though I disputed it. They told me they would mail me a form but I never received anything. Can they collect my stimulus money and what are my options? I’ve been struggling especially during this COVID 19. I really needed my stimulus payment.

I’ve been harassed by transworld over a debt from my military star card. Now I’m receiving garnishments from my civilian employer every paycheck. I did not get a summons or agree to any amount nor was I notified of the collection until it was too late and they already started it. I feel like this was very unethical and pushes the boundaries of being lawful. I’m not even sure if I can fight this or get my money back or what to do.

I had a Military Star card as an employee of AAFES when I left the balance as 3000.00 I filed bankruptcy after I completed the bankruptcy I was told by Transworld they had the debt and because it was AAFES this would be handled like a Student loan and not a part of my bankruptcy, as of today i have paid 6715.00 on this debt and now Transworld has sent a new garnishment for an additional 2100.00 can they do this will this ever be paid and how can fees be more than the original debt, why do they keep raising the balance each time I pay this off.

Transworld services is garnishing my wages on behalf of aafes they say I owe 20,000 and more than half of that is penalties I guess. They are currently taking almost $200 a week!! That's $800 a month. I'm I'm construction worker and this is crippling me. Would really be interested in speaking with someone asap.

I'm started with a estimate of $7000 military star card debt. Was never able to pay and after about 6 - 7 years they began to take out my taxes. I've tried many different avenues with credit repair agencies to try and work with them but they never were able to. Now they have threatened me with a wage garnishment letter if I don't begin to pay. Can you please call to provide any help. With taxes garnished alone I've paid close to what the full balance that was initially owed. Now they say I owe around $16000 still.

I called Transworld last week and was informed that the extra money was to cover interest and that last week was the last deduction. The agent also stated I would be receiving a $96 check because they went over the balance. However I checked my paystub today and they garnished an additional $154.61 after they said my balance was paid. I reread the garnishment order and it tells my employer to continue to garnish my wages until Transworld orders them to stop. They have deducted from my taxes and garnished my wages at 2 other employers. It truly feels like it will never end.

I had a military star credit card about 10 years ago or more and today they automatically started garnishment of my pay. I have not used this card over 10 years . I just got off the phone with Transworld systems and they say the card is federally insured so they can automatically deduct $224 from my paycheck every two weeks is this legal

Have just had a wage garnishment put into effect from Transworld for a debt owed from several years ago for a Star card account. The issue is two-fold. Firstly, they have sent paperwork to ADP, Inc which claims the debt is for a student loan (which is a fraudulent statement on their part), and secondly, to my knowledge, according to federal law, a federal agency cannot garnish my wages if I have not been employed for a 12 month period. (This is even stated on paperwork I have received from Transworld themselves.) So for them to institute a garnishment from my pay at this time is also fraudulent on their part to my understanding. And the kicker is that they have my employment start date shown clearly on the papers they sent to ADP, Inc. I have repeatedly filed a hardship request with Transworld over several years due to the few jobs I have and limited income I have had. Please tell me there is something I can do to stop them since they have apparently decided to put out false info in order to take money from me. One other issue I have is the fact that the credit account has been closed/charged off for several years and yet they have continued to charge monthly interest on the account as if it were active. This has caused the account balance to multiply several times over. I have never seen a debt do this and would like to know if this is legal. I'm hoping you can help me.
