73-Year-Old Pedestrian Killed Crossing Illinois 159 Near Caseyville
Illinois State Police announced a 73-year-old man was struck by a vehicle as he was crossing Illinois 159 in Caseyville on Wednesday night.
According to state police, the incident occurred on November 18 in the northbound lanes of Illinois 159 at Hollywood Heights Road. A driver identified as Kerry A. Douglas of Collinsville was reportedly traveling north on Illinois 159 when he struck a pedestrian who was attempting to cross the roadway.
“The pedestrian was in the middle of the left lane of the northbound lanes of Illinois Route 159 when he was struck by a silver 2008 Saturn Outlook,” a release from the state police said.
The pedestrian suffered critical injuries and was transported to St. Elizabeth’s Hospital, where he was pronounced dead at 9:15 p.m. He was identified by the county coroner as Joseph J. Maly of 700 block of Hollywood Heights Road.
Douglas and his passengers were not injured in the collision. It is unclear if he faces any charges or citations for his involvement in the crash. The investigation is ongoing.
Pedestrians often suffer serious injuries in auto accidents due to simple exposure. According to the Centers for Disease Control and Prevention, almost 6,000 pedestrians were killed in U.S. roadways in 2017. An additional 137,000 pedestrians required treatment for non-fatal injuries in that same year.
As the investigation into the Caseyville crash continues, Joseph Maly’s family may be entitled to a wrongful death claim. Under Illinois law, a “wrongful death” is one that occurs due to another person’s negligence, and this can include pedestrian accidents. The families of wrongful death victims have the right to seek compensation for loss of companionship, emotional distress, and pain and suffering following an unexpected death.
