Isaac Martinez Killed in Chicago Bicycle Accident; Oscar Martinez Guerrero Arrested
Chicago police have identified 13-year-old Isaac Martinez as the cyclist who was struck and killed by a hit-and-run driver in the Southwest Side Ashburn neighborhood on Sunday evening.
According to Chicago police, the crash occurred at approximately 6:50 p.m. June 28 in the 8300 block of South Lawndale Avenue. Martinez was reportedly biking south on Lawndale when the driver of a Ford van that was also southbound struck him from behind. The driver did not stop to render aid, police said.
Martinez was rushed to an area hospital, where he was pronounced dead. No other injuries were reported.
After reviewing surveillance footage of the collision, police were able to arrest the driver responsible three blocks away in the 3600 block of West 85th Place. He was identified as 40-year-old Oscar Martinez Guerrero. He was charged with felony counts of leaving the scene of an accident resulting in injury or death and failure to report an accident resulting in injury or death.
Martinez’s death comes less than a week after the driver of a Chicago Department of Transportation vehicle critically injured a woman cycling at Milwaukee and Belmont avenues in Avondale. So far this year, three bicyclists have been killed in accidents on Chicago streets.
Chicago has a national reputation as one of the best major cities in the U.S. for cycling, but the activity can be dangerous. Over 500,000 cyclists are treated in emergency rooms every year for accident-related injuries, and more than 700 are killed.
As the investigation into Sunday’s incident continues, Isaac Martinez's family may be entitled to a wrongful death claim. The family of wrongful death victims can seek compensation for loss of companionship, funeral expenses, and emotional distress following an accident.
