Swimming pools are typically for fun or relaxing days in the summer, but sometimes, things can go south quickly and unexpectedly. The Center for Disease Control and Prevention claims that from 2005 to 2014, there was an average of 3,536 fatal, unintentional, non-boating related drowning incidents. This is an alarming and scary number to consider, knowing that many of us use pools often when the weather starts looking good. When a loved one has drowned in an apartment pool accident, contact us to set up a free consultation so that we can evaluate your case and help you accordingly.

Some apartment complexes have swimming pools open as leisure and recreation for their residents. When a situation goes terribly wrong at these pools and a person drowns, you may be able to sue the apartment or property owner for negligence. Oftentimes, apartment pools do not have lifeguards on duty to prevent accidents like this from escalating. Even more disturbing, the CDC claims that one in five drowning victims are children 14 year of age or younger. Owning a pool comes with the responsibility of maintaining a certain standard to ensure the safety of others. Additionally, being a property owner comes with the responsibility of a duty of care owed to residents so that they are safe. When they fail to fulfill these responsibilities, they may be found liable for negligence in a premises liability case.

To prove negligence, one must prove that the defendant owed a duty of care to the victim, which in the case of an apartment or property owner, they do. You must prove that this duty was breached in some way, such as lack of warning signs of the water’s depth or lack of lifeguards. Then, you must prove that you actually did suffer injuries/damages, which can be proven through things like medical records and personal testimony, and that they directly caused your injuries.
