  4. What type of debt is covered under state laws that protect me from original creditors? Only consumer debt, such as personal, family, and household debts. For example, the money you owe on a personal credit card, an auto loan, a medical bill, or a utility bill. State laws usually do not cover debts you incurred to run a business, or debts regarding unpaid taxes, or traffic tickets.

  5. Does the Fair Debt Collection Practices Act apply to banks or credit card companies? No. Only third-party debt collectors are bound by the FDCPA. That is, original creditors, such as credit card companies and banks, are not bound by the FDCPA.

Loan with Atlas Credit,own over $1,300 and got behind on payments.Turned account over Clear One Advantage.A debt consolidation company.Atlas rufuses to accept the consolidation plan.Starts calling me several times a day regardless of debt consolidation.District manager yells o phone that they wont take consolidation plan and she said Atlas will sue me if I dont.

Me and my common law husband Each took out a loan and now are unable to pay. Atlas is constantly calling and texting harassing texts. And now texted they will be at our home tomorrow. I just want it to stop. We cannot pay my overtime was cut months ago my husband is on disability. We can only pay our necessary bills and groceries. Health insurance. Is this normal for them to constantly call n text. And now come in person. Please advise

Hi Erica. I'm sorry to hear that you and your husband are struggling and now dealing with harassment from Atlas Credit Co Inc. Sending someone in person to contact you about a debt is rarely done as it is expensive, however some creditors do still send out a representative. There is little they can do other than ask for a payment, but you are not required to deal with them at that time. They can't take any of your property, force you to answer the door, enter your home, contact your neighbors, impersonate law enforcement, harm you, humiliate you, or refuse to leave if you ask them to. I was sued by atlas I stopped paying because they sent a guy to my house he constantly text me asking to go out and I’m so beautiful and was also humiliated on social media

I took out a $1000 loan from Atlas Credit in Longview, TX. Due to other bills piling up and making less money, I have not been able to pay them. They started calling constantly, sending rude text and voicemails, and even started coming by my home multiple times leaving letters in my door. One time I was home, and my daughter was walking inside, and they stopped her to ask if I was there. They are a nightmare to put up with and I have told them multiple times that I cannot pay. I can barely get by. They did say they just wanted to talk but I can only manage a very small payment and did not want to hear what they had to say after their text and calls. Now they have threatened to sue and sent a picture of a receipt from the Justice of the Peace.

I did receive a loan from them about $1200 I believe, and I was making payments at first because mind you this was when Covid was around, so I needed the help, but as soon as I got behind they started threatening me saying they were gonna send the Constable to my job to take me, they were constantly calling my job being rude to my co workers that answered the phone, one time the lady told me, they didn’t hesitate to give me the money so I need to make a payment or I’ll be going to Jail, I told the lady I can’t afford it, I was trying to make payments her and there, but other bills come up as well, I told the lady to just send me to collections since it’s already on my credit report and she tells me we don’t send people to collections it’s done in house.. I honestly wish I could pay them off so they can stop harassing me.. I am going through a separation with my husband and the harassment is so stressful. When you tell them you don’t have it. They get mad and think they can disrespect you. If I can’t pay the loan back, they can’t make me have the money I don’t have, but it’s constant text messages, them texting me saying they are going to pull out the whole $1200 because I haven’t made a payment, is a threat to me. And I respond by saying do not pull any money I don’t have or my back will be overdrawn negative. I need help getting them off my back.
