Bulldozers are massive vehicles used in construction sites to move materials around the site. According to the Bureau of Labor, 18.4% of construction site related fatalities were due to bulldozers. What kinds of accidents and injuries can occur?

A bulldozer can have inherent defects, which can be some of the riskiest since they are so large and powerful. If a bulldozer goes out of control, we do not know what can happen next. Bulldozer operators also must be highly skilled and trained to operate the machine. When they are not, they can wreak havoc and lose control of the machine which can throw dangerous materials around or hit people or cars. Who is liable?

These lawsuits are based on negligence, which is when one breaches the duty of care owed to another and it directly causes their injuries. Bulldozers are often owned by a construction company. This company can be held liable for an inexperienced bulldozer operator, as it is considered negligent hiring. By putting an inexperienced operator in power, they put everyone else around them at risk. The driver or company could be liable if they are experienced but are operating the bulldozer recklessly and negligently. The driver is almost certainly liable if they run over a pedestrian or other driver since they should have exercised their duty of care by checking their surroundings for others fully. If the bulldozer has an inherent defect, the manufacturer of the bulldozer can be liable due to its construction. On the other hand, if it was an issue of maintenance or inspection, the company can be liable since it is their job to periodically conduct inspections.
