Pools and beaches can be a destination for some quality time with your family and children. Unfortunately, these days can suddenly go very wrong. Children don’t necessarily understand the severity or danger of a situation like adults do, and this can end in tragic consequences. That is why it is imperative that property owners of any type of pool or beach must exercise extreme care when opening to the public. When they fail to uphold this standard, they may be found liable for negligence.

Children suffer from drowning accidents often, given the total group size of drowning victims. They don’t necessarily have the skills to handle themselves alone in a body of water, no matter how small it is. These accidents can result in brain damage, long-term disabilities, or even a vegetative state. Pools and beaches are inherently dangerous when there are not ample precautions surrounding them, and especially to small children. They may be caused by defects of the pool and/or its parts, defects of the property, or lack of supervision and warning signs.

To prove negligence you will have to prove that they owed the victim a duty of care, that duty was breached, the victim was injured and suffered damages, and the damages were directly caused by the property owner. You should be able to show that the property owner knew or should have known about the condition that caused the accident. In this case, you would have a case to sue the owner of the property where the accident occurred. You can pursue a lawsuit and be compensated for the damages and pain and suffering that were inflicted upon you and your family.
