Bloomin’ Brands, the Tampa-based parent company of Outback Steakhouse, will soon become the defendant of a proposed class action lawsuit alleging that the establishment sent text messages containing unsolicited advertisements.The lead plaintiff, Nadine Weingarten from Connecticut, filed the case on October 19. The lawsuit claims that Bloomin’ Brands sent text messages through an automatic telephone dialing system to thousands of cellphone owners without their consent. The messages were a violation of the Telephone Consumer Protection Act.The class action lawsuit seeks between $2 million to $6 million. Bloomin’ Brands has not comment on the class action law suit, yet. Bloomin’ Brands is also the parent of Bonefish Grill, Roy’s, Carrabba’s Italian Grill and Fleming’s Prime Steakhouse & Wine Bar.The Telephone Consumer Protection Act (“TCPA”), passed in 1991, restricts telephone solicitations and the use of automated telephone equipment. Specifically, the TCPA limits the use of automatic dialing systems, prerecorded voice messages, and unsolicited text messages.Today, consumers receive more robocalls and unsolicited text messages than ever.
