Every day, millions of children across the U.S. cross busy streets on their way to and from school. Parents trust that their children will be kept safe by school districts and school crossing guards, however this is not always the case. Crossing injuries are all too common and are often due to the negligence of someone that was trusted to keep your child safe.

We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, Mike Agruss Law is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Legal Liability in Crossing Injuries

There are many factors that can contribute to a crossing accident. Schools have a duty to provide reasonable safety for the children under their care and while most school crossings are not on school property, when a school provides a crossing guard in these areas, they continue to exercise control over the safety of their students when they use these crossing areas and may be held liable for an accident that occurs even off of school property.

Some of the most common reasons that crossing injuries occur include:

  • Reckless driving
  • Speeding
  • Lack of visibility
  • Improperly marked crossing zones
  • Lack of warning signs
  • Lack of crossing guards
  • Untrained crossing guards

If a crossing guard is negligent in their duties and a child is injured, or a child is injured in a crossing accident and it can be shown that a crossing guard was improperly trained, both the crossing guard and the school could be found liable for the child’s injuries and damages.

Sometimes crossing injuries occur due to no fault of the crossing guard or school district and instead are due to malfunctioning crossing alerts, lack of signage, poor sidewalk and street conditions, or reckless driving. In these situations, the driver, those responsible for maintaining the sidewalk or street, and even sign manufacturers could be found liable for your child’s accident.

Crossing accidents can be complex, but an experienced personal injury lawyer can review your case and determine who may be liable for the injuries your child sustained and fight to get them the compensation they deserve.
