The typical defendant in a dram shop case is a “commercial vendor or supplier of alcohol,” while social hosts and other non-commercial suppliers are typically protected against such liability. According to Section III A. [4.4] of the Illinois Dramshop Practice Act handbook issued by the Illinois Institute for Continuing Legal Education (IICLE):

“Because the purpose of the Dramshop Act is to protect innocent persons by placing the burden of the evils of the liquor trade on those who profit from it, the proper dramshop defendant must generally be a commercial vendor or supplier of alcohol…Noncommercial suppliers, including social hosts and even those who arguably receive a small charge or other consideration for the alcohol, traditionally have not been held liable under the Dramshop Act.

Thus, Illinois courts have generally…drawn a sharp distinction ‘between those engaged in the liquor business for profit and those who hold social gatherings where liquor is dispensed.’”
