Children are vulnerable to disease and injuries, but parents hope that when an issue arises, their physicians and medical team will be there to provide a correct diagnosis and the treatment that their child requires. Unfortunately, physicians can make mistakes and a diagnostic error can lead to incorrect treatment, delayed treatment, or no treatment at all. These oversights can not only make your child’s condition worse; it may even lead to death.

If your child has been injured due to a diagnostic error, contact Mike Agruss Law for a free consultation. We are a Chicago-based injury law firm representing individuals (and their families) who have suffered an injury in an accident. We will handle your case quickly and advise you every step of the way, and we will not hesitate to go to trial for you. Lastly, Mike Agruss Law is not paid attorneys’ fees unless we win your case. Our no-fee promise is that simple. You have nothing to risk when you hire us – only the opportunity to seek justice.

Common Types of Diagnostic Errors

There are a variety or ways diagnostic errors can occur. These include:

  • Failure to diagnose-It is common that serious medical conditions, such as appendicitis, meningitis, and leukemia, are mistaken for other, less serious issues, often delaying treatments.
  • Medication errors-The wrong medication or a medication at an incorrect dosage can have serious and long-lasting consequences for a young child.
  • Negligence-It is not uncommon in today’s overworked hospitals and doctor’s offices for caregivers to fail in allocating sufficient resources to patients that may be viewed as a lower priority. If you feel your child did not receive adequate attention for their medical issue, you may have a claim on their behalf.

Medical malpractice can be difficult to prove. For a medical malpractice claim to be successful, the following must be shown:

  • A doctor-patient relationship existed;
  • The doctor was negligent in the care of your child;
  • The negligence of the doctor caused an injury to your child;
  • The injury caused compensable damages.

Every case involving diagnostic errors and medical malpractice will be unique and so will be what compensation your child may be entitled to. Because these types of claims can be complex, it is important to contact an experienced personal injury lawyer as soon as possible to determine who may be liable for your child’s injuries.

We at Mike Agruss Law are proud to serve our fellow citizens in personal injury cases, especially when you or a loved one has been injured, and we are fully committed to protecting your rights and ensuring that the other party is held legally accountable when negligence occurs.
