According to Chapter 1, Section II. C. [1.20] of the Illinois Dramshop Practice Act handbook issued by the Illinois Institute for Continuing Legal Education (IICLE):

“The Drug or Alcohol Impaired Minor Responsibility Act (DAIMRA), 740 ILCS 58/1, et seq., provides that any person at least 18 years of age who willfully supplies alcoholic liquor or drugs to a person less than 18 years of age and causes the impairment of such person shall be liable for death or injuries to persons or property caused by the impairment of such person (740 ILCS 58/5(a)). Claims must be commenced within two years after the right of action arises (740 ILCS 58/5(c)).

Economic damages, including the cost of treatment and rehabilitation, medical expenses, loss of economic or educational potential, and any other pecuniary loss proximately caused by the impairment of the person under the age of 18, are recoverable as are noneconomic damages for pain, suffering, physical impairment, emotional distress, and any other nonpecuniary losses proximately caused by the impairment of the person under the age of 18. Reasonable attorneys’ fees, expenses, and punitive damages are also available under the DAIMRA (740 ILCS 58/10).”
