Scooters are becoming a more and more popular form of transportation with companies like Bird and Lime making scooter transportation available to anyone. People “unlock” the scooter on an app to activate it, head to their destination, and “lock” the scooter on the app when they are done, leaving the scooter there. However, scooter trips are not always this simple and risk-free. If you or a loved one has been in an electric scooter accident, contact us for a free consultation to see if you may be entitled to compensation.

What kinds of accidents and injuries can occur?

These scooters can travel at fairly high speeds of up to 17 miles per hour, yet there are few laws or regulations governing their use. This is since it is such a new form of transportation. Nonetheless, accidents still occur. A scooter may be left on the sidewalk for someone to trip over, a scooter can get hit by a car or they may hit the car or another object on their own, the scooter may be defective, or the scooter driver may be driving it recklessly. Any of these accidents can cause bruising, broken bones, concussions, cuts and scrapes, neck or back injuries, and much more.

Who is liable?

In an electric scooter accident, the liable party is whoever was negligent and essentially caused the accident to occur. If the scooter driver is driving recklessly, such as going too fast where it may be dangerous or taking sharp and fast turns, they would likely be the liable party. If the scooter is defective and caused an accident, the scooter company would be liable for negligently releasing a defective product. If you trip and fall over a scooter left on the sidewalk, the scooter company or even the city can be held liable for the accident. In a scooter-and-car crash, the liability would be determined and mediated by an attorney to investigate who was not following the law or rules of the road. Ultimately, liability depends largely on the type of accident, and speaking to an attorney can clear up any confusion that you or the two parties may be having regarding who is at fault.
