Causes of Fetal Death

Fetal death cannot always be prevented, even with all the medical advances we have today. However, many cases can be. For example, if a medical professional fails to recognize the signs of fetal distress, they may be held liable for the resulting stillbirth of a child. Other causes of fetal death can include: 

  • Failure to advise on proper prenatal care
  • Fetal asphyxia
  • Delayed cesarean section (C-section)

Legal Liability in Fetal Death

Various parties could be found liable in the event of fetal death depending on the specific circumstances of your case. This can include: 

  • Medical Malpractice-Medical malpractice can take on many forms and may include incorrect prescriptions, errors during labor and delivery, misdiagnosis, and failure to provide proper prenatal care. Not only could the medical professional(s) be found liable for fetal death, but also the hospital that employed them could be found liable for the death of the fetus if their negligence is found to be the causing factor in a fetal death.
  • Premises Liability-If a pregnant woman is injured on someone’s property and she loses her child, the owner, operator, or manager of the property could be found liable for the death of the fetus under the law of premises liability.
  • Negligence-Negligence in many forms may result in the death of a fetus. For example, a driver who causes a car accident that results in the loss of a child could be held liable for that fetal death.
  • Defective products-If a piece of medical equipment, such as a fetal monitor or ultrasound device, used during the birthing process can be shown to have caused fetal death, or if a defective car part caused a car accident which resulted in a fetal death, the product manufacturer or anyone else in the chain of distribution of the defective product could be found liable.
