Children love spending time on playgrounds and while most playgrounds are designed with the safety of children in mind, equipment can still be dangerous, especially for young children that are left unsupervised or unattended.

When you place your child under the care of another person, such as a school or babysitter, they owe a duty to your child to keep them safe, However, if your child was injured on a playground due to lack of supervision, they may be entitled to compensation for their damages.

Lapses in Playground Supervision

Young children require proper supervision at all times, especially when they are playing on playground equipment, which can be dangerous. When children are not supervised, they can suffer serious, and sometimes deadly, injuries. Common lapses in playground supervision that can put children at-risk include:

  • Adult supervision out of the line of sight or out of hearing range
  • Failure to walk around as children play to ensure they are playing safely
  • Failure to warn children of risks on the playground
  • Lack of communication between supervisors
  • Failure to intervene when children are playing dangerously

Legal Liability for Lack of Playground Supervision

When an institution or an individual accepts responsibility for caring for your child, they owe your child a duty of care to adequately supervise them. When they breach this duty of care, the supervisor or caregiver could be found liable for the injuries your child sustains if the negligent supervision was the cause of their injuries.

Rules regarding liability will vary with the type of playground that the accident occurred on. For example, public schools are typically granted a level of immunity for certain injuries sustained by children while under their control and damages are usually capped. This also normally applies to state and city-owned playgrounds as well.

Determining who may be liable for your child’s injuries due to lack of playground supervision can be tricky, but an experienced personal injury lawyer can review your case and work to get your child the compensation they may be entitled to.
