A birth injury can be devastating and life changing for both parents and their new child. Parents never expect that a birth injury could occur, but the sad reality is that birth injuries in hospitals do occur. Unfortunately, these injuries are not always immediately apparent and may appear months or years later.

How Do You Know If Your Child Suffered a Birth Injury?

Doctors, nurses, or midwives will perform an APGAR test both one (1) minute post-birth and five (5) minutes post-birth to determine if a child suffered a birth-related injury. The APGAR test checks for appearance, respiration, pulse, reflex irritability, and activity and low APGAR scores are an early indicator of a birth injury and babies with a low score should be closely monitored on an ongoing basis.

Because birth injuries are not always immediately obvious, parents should watch the development of their children closely if they suspect there was an injury at birth. If your baby struggles to meet milestones, such as lifting their head up or learning to crawl or walk, it could be a sign that your child suffered a birth injury that caused permanent damage.

Don’t Wait To Take Action

Most birth injuries are completely preventable and almost always the result of medical malpractice, which is why it is important to take action as quickly as possible. It is likely that your child will have ongoing, long-term medical needs and those that are responsible for their injuries should be held accountable for their negligent actions.

If you suspect that your child suffered an injury at birth, contact an experienced personal injury lawyer as soon as possible to review your case and determine who may be liable for your child’s injuries and what compensation your child may be entitled to.
