In early April, 2013, Florida fined the Avante at Ormond Beach nursing home $36,000 fine against for its poor handling of a sexual abuse allegation. Inspectors working for the Florida Agency for Health Care Administration found the nursing home did not properly report an allegation that an employee crawled into bed with a patient.

This is a pretty steep fine by state standards—the most serious offenders typically see fines of about $40,000. The incident happened in January 2012; a resident at the nursing home accused a nursing home employee of climbing into bed with her roommate. The resident’s roommate denied the incident, according to the report filed—but, the staff did not call police or social services, as they are required to do with sexual assault allegations. Initially, state regulators levied a $45,000 fine against the nursing home but settled for a lesser amount.

The nursing home has been issued a conditional license, which means it’s on notice and liable for further inspections. Avante, which did not return media calls for comments, has 30 days to pay the fine.
