In April, 2013, a nursing home in Florida was penalized $36,000 by the state’s Department of Health, for failing to report an alleged sexual assault. Located in Ormond Beach, the home is run by Avante, and most of its residents are fully dependent on its staff.

The state’s report found the nursing home’s actions put other residents in danger. Here’s what happened, according to state records: in January 2012, a female resident told her husband that she saw an employee get in her roommate’s bed. Instead of following Florida’s mandatory reporting law, staff members tried to do their own investigation and questioned the roommate themselves. The nursing home’s director didn’t learn of the alleged incident until the woman’s husband wheeled her out of the building, saying he could take better care of her at home.

The nursing home didn’t report the possible assault to police until a state agency got involved. In a 25-page complaint, the administrator of Avante told the state agency, “I screwed up. I should have reported this.” The roommate (who was possibly assaulted) has denied that anything happened; the state reports says she may have been afraid to tell staff what happened. Avante finds itself now on a federal and state watch list—it will be closely scrutinized for nearly three years.
