Construction accidents occur daily and the majority of these accidents are serious, even fatal. According to the Occupational Safety and Health Administration (OSHA), the Federal organization tasked with setting and enforcing the regulations that keep American employees safe as well as investigating serious injuries, illnesses, and workplace deaths, there is an average of 100 worker deaths in the construction industry weekly, or 14 deaths every day.

OSHA has 85 local offices and 10 regional offices with approximately 2,100 inspectors responsible for the safety of 130 million workers, or one compliance officer for every 59,000 workers. When a construction site accident occurs, an OSHA violation has likely occurred.

Common OSHA Violations

According to OSHA, four common violations occur frequently, dubbed as “The Fatal Four”. These four types of accidents are responsible for more than half of construction worker deaths and include:

Falls-Employers are required to provide safeguards to prevent workers from falling more than six (6) feet.

  • Struck by an object – Workers are required to wear personal protective equipment (PPE) and employers are legally required to provide these items.
  • Caught in equipment – Protective systems that prevent an employee from getting any part of their person caught in equipment must be in place.
  • Electrocution – If electrical systems are on the worksite, employers are required to protect their workers.

When an employee is injured on the job, it is important to ensure that a thorough investigation of the accident is completed. If violations are found by OSHA, they may order the employer to pay fines, and in cases of numerous violations, a worksite may be shut down completely. Because of the regulations enacted by OSHA, workplace safety has been improved significantly and workplace deaths have decreased dramatically, however, construction accidents can still occur.

Employers have a duty to provide a safe working environment. When these employers fail, their employees can be seriously or fatally hurt. Employers that disregard the safety of their workers need to be held accountable.

If you or a loved one has suffered injuries due to negligence on the job site or a defective product, an experienced personal injury lawyer can review your claim and determine if there were unsafe working conditions, potential OSHA violations, and other hazards that may have existed at the time of your accident. They will also determine who may be liable for your injuries and damages and what compensation you may be entitled to.
