Pain and suffering is a common component of plaintiffs’ compensation in dram shop cases. According to Chapter 1, Section 2. [1.8] of the Illinois Dramshop Practice Act handbook issued by the Illinois Institute for Continuing Legal Education (IICLE):
“Illinois courts have recognized that pain and suffering is an element recoverable as personal injury against a dramshop (Maras v. Bertholdt, 126 Ill.App.3d 876, 467 N.E.2d 599, 81 Ill.Dec. 728 (2d Dist. 1984), abrogated on other grounds as recognized by GMB Financial Group, Inc. v. Marzano, 385 Ill.App.3d 978, 899 N.E.2d 298, 326 Ill.Dec. 81 (2d Dist. 2008). The Maras court further held that based on the language contained in the Probate Act, all actions, including those based on injury to the person, survive the death of the injured party. 467 N.E.2d at 607.”
