Passenger vans are vans that are intended for usually 12-15 passengers. They are often used to transport members of an organization, such as a school or church, from place to place as it saves on costs and seems more efficient to the organization. According to the National Highway Traffic Safety Administration (NHTSA) passenger vans with 10 or more passengers are three times more likely to be in a rollover accident than a more lightly loaded car. What risks do 15-passenger vans pose?

Given these vans’ high occupancy level, the center of gravity is shifted towards the back of the van rather than being equally distributed, making it more prone to be in a rollover accident. They are simply manufactured in a way that is inherently dangerous. This can lead to a rollover accident from weight imbalances, a tire blowout due to the heavy weight, drivers inexperienced with handling the van and the control needed in a passenger van, not using seatbelts, overloading, and more.

Who is liable?

These types of accidents can cause broken or fractured bones, concussions or traumatic brain injuries, lacerations, and extensive hospitalization, at times. They can even sometimes lead to death. The NHTSA says that between 1994 and 2004, 1,512 large passenger vans were involved in fatal crashes. If the accident is caused directly by an inherent flaw in the van’s construction, you may be able to find the van manufacturer liable for your injuries. Otherwise, the liable party may be the driver of the vehicle if you can prove that they were driving negligently, or the organization that purchased the van to transport your group (your school, your church, etc.).
