Personal injury is perhaps the most common basis for a plaintiff to pursue a dram shop claim with the help of an experienced attorney. According to Chapter 1, Section IIA. [1.6] of the Illinois Dramshop Practice Act handbook issued by the Illinois Institute for Continuing Legal Education (IICLE):

“Every person who is injured within this State, in person or in property, by any intoxicated person has a right of action in his or her own name, severally or jointly, against any person, licensed under the laws of this State or of any other state to sell alcoholic liquor, who, by selling or giving alcoholic liquor, within or without the territorial limits of this State, causes the intoxication of such person. 235 ILCS 5/6-21(a).

Persons licensed to sell alcohol (the “dramshop”) and who by selling or giving alcohol caused the intoxication of a person, who in turn caused a loss, have liability under the Dramshop Act. A cause of action against a dramshop requires three elements: first, a gift or sale of alcoholic liquor by a person licensed to sell alcoholic liquor under Illinois law or the law of another state, and then two elements that must coexist at the time of the occurrence that produces the injury — intoxication and then physical activity by the intoxicated person causing the loss or injury.”
