In Illinois, the state statute states that there must be clear and convincing evidence of this outrageously reckless behavior in order to be awarded for punitive damages. Illinois law also limits punitive damages to up to three times the total amount of your economic damages, which have a quantifiable value to them, such as medical expenses.
