People go to a restaurant to have relaxing and enjoyable quality time with their loved ones. Unfortunately, some restaurants fail to honor this expectation when they are unable to keep the premises completely safe for others. Incidents of people tripping or slipping and falling in restaurants are not quite uncommon, and it can seriously hurt people. If you or a loved one has been injured in a restaurant trip and fall, you may consider filing a premises liability lawsuit against the restaurant.

What accidents can occur in a restaurant?

Restaurants are very busy places with waiters waiting on several tables at once, trying to get their food to them in a timely fashion, meanwhile the cooks in the back are trying to cook everything in time as well. In such a bustling environment, there should be ample control for the safety and security of its guests so as to prevent any possible injuries from occurring.

Restaurants may have fallen objects from the waiters, the ceiling, or other guests that have obstructed a walking area. People can trip and fall on these at any time, especially in a dimly lit restaurant. Dimly lit restaurants are also generally hazardous as people may be unable to see the floor below them. This can result in people not anticipating any obstruction on the floor, or being unable to see stairs and falling down a whole flight. Perhaps a waiter accidentally spilled a drink on the floor. An example of proper protocol would be to close that area off and clean it before people can walk around it. Another example would be an uneven floor that causes people to step just before it and trip on the raised level.

Any number of injuries can come of these accidents. People can get broken or fractured bones, facial injuries, concussions, traumatic brain injuries, or even paralysis. One case of a man tripping over uneven flooring in a restaurant resulted in a cerebral hemorrhage, or excess fluid buildup and pressure in the brain, causing his death two days later. These are serious accidents that should be promptly remedied as best as possible with the help of your own attorney looking out for your best interests.

Who is liable?

If the restaurant fails to protect its customers in this way, they can be found liable in a premises liability case. Premises liability laws set out to protect people on another’s property. If a property owner has not kept their duty of reasonable care to ensure the safety of others, and this has resulted in someone getting injured, the victim can sue the property owner for their negligence. You should just be able to prove that the restaurant failed to keep their customers safe, they caused your injuries, and you suffered damages from it.
