School districts have a responsibility to their students to provide a quality education, a safe environment, and a quick response when there are any issues throughout the day. School District Liability

School districts in Illinois fall under the law of the Local Governmental and Governmental Employees Tort Immunity Act. This act creates a high burden of proof for the injured party and generally protects public employees from liability unless the injury was due to willful or wanton conduct.

Under the theory of negligence, however, plaintiffs have less of burden of proof. Under this theory, the plaintiff needs to demonstrate that the negligence of the school district caused an injury, such as an injury due to a failure to maintain a safe environment or children who were injured due to the inattentiveness of a teacher. 

When a school district employee is determined to be negligent, the school district could be found liable as well under the theory of vicarious liability. They could also be found directly liable if policies they had in place, or did not have in place, caused an injury, as well as during some instances of a sports-related injury and/or dangerous/neglected playground injuries.
