Though we go to pools to have a fun and relaxing day, there are a variety of risks that accompany such a visit. When pool owners breach their duty of care that they owe to invitees and licensees, people can get injured as a direct cause of their negligence. One of the most severe injuries that one can get is a spinal cord injury. This situation may be a premises liability case since a person was injured on someone’s property due to the owner’s negligence, and you can be compensated for your injuries and damages when you seek justice.

According to the National Spinal Cord Injury Association, about 17,000 new spinal cord injuries occur every year – most caused by damage to the vertebral column which affects how messages are sent and received in the body. Spinal cord injuries are any damage to the vertebrae, ligaments, or disks in the region. The spinal cord is connected to the brain, and together, they constitute the central nervous system. The central nervous system is generally responsible for sensory, automatic, and motor function, as well as sending messages to your brain. It is unable to repair itself once damaged. These types of injuries can result in lifelong paralysis.

Spinal cord injuries are either complete, incomplete, or spinal concussions. A complete spinal cord injury occurs when all sensory and motor function is lost below the injury, which many know as total paralysis or paraplegia when a person is paralyzed from the waist down. An incomplete injury occurs when a partial motor function is lost but some function still remains; this type of injury exists on a spectrum of severity. A spinal concussion can be an incomplete or complete injury but resolves itself within days. Any of these three may be possible with a pool accident, it simply depends on the circumstances surrounding it.

At a pool, a spinal cord injury may occur after diving in the shallow end, a slip and fall where the victim falls backwards or forwards, a body blow from a large object or another diver, and more. There are risks surrounding us, so it is imperative that pool owners take the necessary precautions in the warning signs, staff, and design of the pool so that people are as safe as possible.
